The hotel from hell

Hi,

My wife and I are currently in Paris For our anniversary and have booked the hotel from hell! One night in and we want out ( the Walls are so thin you may as well sleep In the street (or at least try to). We haven't slept a wink on this our first night

so we shall be leaving this morning and finding a better hotel. My question is this: we paid a deposit of one night via credit card (at lastminute.com) and have still to pay for the other two nights. If we leave is there a chance the hotel could add further charges to the card? If so could we avoid this by cancelling the card/reporting the cars stolen?

Hopefully we can sort thus out with the hotel ambically but I just want to know where we stand as I don't trust the hotel owners.

    Surely if you contact your Credit Card people and start a chargeback, you will get the lot back including night one, without lying or committing a possible fraud, I hear the nick in France isn't up to Les Routier's standards.

    The bank won't let you do a chargeback until you can prove you've attempted to resolve the situation with the merchant first.

    Unfortunately there isn't much you can do. Is the hotel 'as described'? And I mean in real objective, not subjective terms here. If there isn't something you can point to, to say 'that's wrong' then you won't get much joy.

    My girlfriend did once get money back from lastminute.com, but it involved an intensive two month long campaign with dozens of phone calls and letters before she could even get past the people who just sent out standard replies. And that was for something quite fundamental, i.e. she'd booked an en-suite room and the hotel did not have any!

    Let's get this straight. You've gone to France and booked a hotel via lastminute.com and aren't satisfied with the hotel so you are thinking of leaving and cancelling the card or falsely reporting it stolen to get out paying the other nights you booked in advance?

    On what basis are you thinking, adouglasmhor, that the original poster could get a chargeback? We went on holiday and didn't like it?

    incesticde you need to speak to the hotel and tell them you are unhappy with the noise level in your room. Then look at your booking terms and conditions and see if cancellation for the remaining two nights is permitted. If it's not then you are stuck with paying for it (for example, if it's part of a three night minimum stay).

    Where were you thinking of going? Do you know if there are any vacancies tonight and tomorrow (Friday and Saturday) for you to stay in. Don't fall out with the hotel and then find yourselves on the street!

    The noise levels in the hotel being unacceptable and not being able to sleep may be reason enough if the hotel does not take steps to resolve it, one of the main reasons people go to hotels is to have somewhere to sleep.

    I have no real intention to do a runner… if this can be sorted out amicably with hotel people then cool…I'll take the hit on the first night and move on.

    If I do the above then I wanted to know what the hotel could do. in terms of false charges to my account.

    Sorry IF it sounded as if i was going to do a runner , that wasn't my intention. But if you had no sleep last night you probably wouldn't make sense either!

  • What terms did you book the hotel on? Was there a cancellation period?

    Can't the hotel resolve the matter by moving you to another room? As has been said before you really should allow the hotel the chance to rectify the problem, your credit card company won't be interested unless you do so (rightly). Bare in mind Paris hotels are notoriously noisy in general.

    I work chargebacks daily. I wouldnt touch yours at all to be honest. As its prev been posted. The only option would be a chargeback 4853 Not as Described. The fact its noisy and has thin walls is not going to do anything to allow your bank to chargeback the transaction.

    You have paid for a hotel room, you have recieved the service, your unhappy with the noise level,there is nothing mastercard/visa regualtions thats going to cover your back its pretty much a customer/merchant dispute. Noise level is subjective, what is too noisy for you may not be for someone else. If you follow. Now i kno anyone with a bit common sense will be able to determine when its unacceptable, there is nothing to cover your back. For Not as described you would be looking at the lines of " i paid on my invoice for a room over the pool, and i recieved a basement room with no windows, merchant refused to change etc etc. that is quite an out there example but I feel most people should get the idea...

    Hopefully if you follow the hotel/ bookers complaints procedure you might get it resolved and moved to a different room.refund.

    If you do just decide to leave you will be billed for the full stay regardless......Sorry to say. unless you can get something agreed with the merchant.

    Oh and cancelling the card will make no difference, merchant will be allowed to bill your account regardless of closing it and they will transfer the debit onto your new card number... sorry
