HP Laptop messed up just out of warranty

Hello there.
I ended up coming here looking up some bank info cause I'm with Halifax, but I thought I would get some advise here...
I bought a HP DV9000 in December 2007. It came with a 1 year warranty, I choose not to spend £200 on the "whatever happens" insurance or an extended warranty.
About a month ago I started getting problems, hundred of vertical lines come down my screen- it is impossible to read the screen, and it has a red/green tint to it. A reboot fixed it so I assumed it was a driver issue.
Anyway, now it does it all the time. I recently found out my laptop model was part of a product recall due to the battery causing overheating and causing the GPU to fail (I think this is what's happened) but when I went into the details my specific serial number wasn't listed and so I wasn't entitled to the free repair service.
Now it is doing it all the time, driver updates, system restore etc don't help I contacted HP. Basically they said because it is out of warranty it is nothing to do with them and I need to go back to the shop (the woman even quoted the sales of goods act).
So I went back to the shop (Currys). They have said it is nothing to do with them because I did not buy the "whatever happens" insurance. The women even said to me I should have bought that then I wouldn't be in this situation.
Do I have a case for anything? No one will take responsibility or even help me, just push the blame. I paid £800 for this laptop and that was in the Christmas sale, it was £1200. I emailed Currys customer support, explained everything and they just directed me to the HP website for the product recall I'd already been through.
Help!
Thanks

You're being fobbed off basically, you have a case and you should win.
There's plenty of cases in this forum if you search for SOGA, or just search through posts I've made in the past because I've commented on practically identical problems.- Curry's store response is legally ignorant (short and sweet).
- Under Sales of Goods Act, an item can be expected to fulfill its intended purpose for a reasonable amount of time. I'd and many many others would argue that a little over 12months is not reasonable.
- At this point, I'd formally write to them advising that they are in breach of the SOGA, and that your are seeking free repair or replacement. Failure to comply, you will seek an independent engineer's report (next bullet pt) which if it finds in your favour, you will then pursue them once more including this time the cost of the engineers survey.
- Because the item is more than 6mths (I'm a little rusty here as I've not been on the forums for a couple of mths), it is up to you to prove the fault is inherent. You will need to pay for an independent engineer to diagnose the fault, state how long he/she would expect a spec / make of this type to last and to add his credentials - i.e. why he / she is qualified to advise.
- A fall back position is your credit card company, they are equally liable (need to quote consumer credit act)
- You can then expect to take them to court - its good for the soul and will make you a hero on this forum.

Thank you for your reply.
I did buy it on a credit card, but the problem is I hop around the interest free offers. I have no idea which credit card it was or if I even have the account still.0 -
Just a quick update. Currys are paying for the repair of the laptop and refunding me the cost of the report.
Great engineer- if Currys weren't going to cover the cost of the repair he wasn't going to charge me for the report.
So now I am just waiting for the voucher to come through and I can get it sent off (funny, I wasn't allowed the use The Tech Guys to do the report, but I have to send it to them to get it fixed!)0 -

Love it when a plan comes together.................0 -
Hi there Zalensia
I am having the same problem with my 17" HP laptop, it is 14 months old and Dixons/ PCworld keep fobbing me off quoting 12 month cover only, mentioned SOGA as quoted above but still no joy. If you don't mind me asking:-
What model is your laptop?
Which engineer did you use?
Thanks0 -
It's a HP DV9000.
The engineer I used was a local one in my town in Cornwall.
In the end I had to go to head office before I got anywhere. The shops themselves did nothing except fob me off too.0 -
