Can I get my deposit back?
Hi guys!
I am after a bit of advise as recently I agreed to the purchase of a performance car. At the time I was admittedly a bit dubious about the Service History but I was assured that it was complete and as I was in a bit of a hurry I took this as read (for those who are into their performance cars you will undoubtedly be aware of the importance of a good Service History).
I paid a deposit of £400 with the remaining £6600 to be paid when I am due to pick the car up.
Since then I phoned the main dealer services of the car I am due to purchase to confirm the Service History information that they have and they are only aware of the car being serviced twice (it is 6 years old) with the last service being in 2006. It is possible that the car has been serviced independantly since but there is no service book and, therefore, no proof.
As you can appreciate I don't want a car that was last serviced 3 years ago so I am going to cancel the purchase. How do I stand with getting the deposit back as the deposit was put down on a "looked after" car and this is not so?
In the advert for the car it did state that there was a Service History. As there isn't is this in breach of the Sale of Goods Act?
Any advice will be appreciated.

Did the advert say Full Service History....or just service history?;)I am not a complete idiot - some parts are missing;)0

there is a difference between Service history and full service history and full dealer service history
If the owner had cared about the car they would of kept all the history together, i assume you signed the contract which in my eyes would say you are happy with the condition
I wouldnt give you the deposit back if i was the garage, but you can probably get it back if you try hard enough0 -

Fair enough! Frustrating as the dealer knew how important the service history was for me.
