More of a legal Police/rights question really...

Hi there,
My sister was recently issued with a 'Harassment Warning Notice' by the Police.
Obviously aint gonna bore you with the details but it's more or less a ticking off for being a pain in the ars3 towards someone - she wasn't threatening or whatever, just 'persistent'!
Anyway, I asked her if she has a copy of it so I can have a look and she hasn't been given one.
Does anyone know if she should have done? It wasn't a official caution or whatever, just the cop writing details in his book and she had to sign it (whether she wanted to or not apparently...)

So your sister is harassing someone and you want to help her get out of it on a technicality.
How about getting her some professional help to sort out her issues instead?0 -

Which bit of my question mentioned that???You have just jumped to that conclusion!!! I just wanted to see her copy of it to see exactly what she has been done for, as her version of events totally differs from her ex friend's version. The harassment thing is such a grey area and all she has done is try to apologise for things that she didn't actually do in the first place but this 'friend' has twisted a situation to blame her.

Maybe the reason you couldn't find the right place is because this has absolutely nothing to do with money saving.

I don't think the post was meant to be rude - in fact that was exactly what I was thinking - I can't imagine that many people on this site would be in a position to advise on something like this.
Maybe you should try calling your local police station to see if they know if she should have received a copy?:A kimmi_b0 -
Presumably she could check who gave her the notice, she could get advice from a solicitor first.Are you saying there has been a mistake of sorts?0

As it's not an official warning, more of a ticking off, then no paperwork has to be given by the police. Basically a "Harassment Warning Notice" is a basic statement saying that she has been doing something wrong, and that she admits, by signing it, that she was in the wrong and that she won't do it again. Her details will be entered onto the PNC, with a note explaining the offence and warning given. This wont show up in ANY other matter (so if she got done for speeding, robbing a bank etc etc, it wouldn't be used against her) it's only brought up again in a similar harassment case.
The police don't issue paperwork for "slaps on the wrist" as if they did, they would spend 99% of their time doing paperwork, instead of 70%...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

there is nothing in the Harassment Act 1997 that states the police have to give a warning. It states if a person is harassed on more than one ocasssion, then a police officer could actually arrest and a person could be charged with the offence of Harassment, however in most cases (non-stalker) type when it has just begun, the police use a bit of common sense and issue a warning and this tends to stop the behaviour, if it doesn't then this acts as evidence to the 'more than 1 ocassion'. It is not something at the warning stage that anyone has to declare on job applications etc, it will only come back into play if your sister continues her behaviour against the said person. Hope this helps.

The question wasn't asked because there may have been a way for her to 'get off' or a mistake made cos she admits doing this persons head in with 3 apology letters she sent (non threatening or rude BTW, just explanatory, but very long!!!) However, she didn't realise that sending nice letters was an offence as she wasn't purposely trying to cause distress or hurt.
We all just want the matter to drop, including the letter recipient, but I just wasn't sure whether she was supposed to have a copy for her own records really.
She did call the Police station 4 times and left her number as no-one was available to answer the question (which is fair enough) but they haven't yet called her back, that's why I thought I'd turn to the useful bods on here save the Police's time.

I'm not making judgment, but perhaps calling the police station four times is a little excessive, and characteristic of her personality? Maybe she should have a chat with her GP about her overzealous persistence?Gone ... or have I?0
