faulty 52" lcd samsung

Hi all,

looking for some guidance in getting out tv repaired. We bought a 52" samsung lcd tv in june 08 paying just under £1500 on debit card for it.

we bought it from letshave-it.com who are not answering the phone and site is apparently down for maintenance. The tv has developed a fault in that you switch it on and it just clicks for a couple of mins before eventually coming on.
I am presuming that the sale of goods act covers us with this as i would expect the tv to last a lot longer than 1 yr 4 months! i don't know what to do as samsung won't do anything and when you call their number 01189406882 i just get answerphone.

could anyone please advise me as to what the next best action would be?

thanks in advance

Not looking good for you, the company that owns letshave-it.co.uk is:

    Name & Registered Office:
    BENNETT CLOUGH HEMANI SUPPLIES LIMITED
    SHEEPLANDS FARM
    TWYFORD ROAD WARGRAVE
    READING
    BERKSHIRE
    RG10 8DL
    Company No. 05563644

But this is what it says on companies house:

    Accounting Reference Date: 30/09
Last Accounts Made Up To: (NO ACCOUNTS FILED)
    Next Accounts Due: 14/07/2007 OVERDUE
Last Return Made Up To: 14/09/2008
    Next Return Due: 12/10/2009 OVERDUE

    Not looking good...

    Tel. no. 0118 940 2277

Although if they're in administration or heading into administration that probably won't help much. If anyone answers and is willing to speak, you could tell them about your problem and ask if they can help, then if they say they're going into administration, ask them for the name of the administrators, ring them.

That's what the Law says - you would be the first to complain if the Law said Samusung were responsible and you had to ship it back to Japan !

Samsung have no legal obligation to you at all - it is with your retailer. Appreciating that your retailer's position is not looking too rosy, your usual next port of call would be the credit card company but as you've bought it on a debit card, the consumer credit act does not apply.

Without sounding too dour, its not looking good. I'd get the TV fixed at your cost (google the fault first, it may be a simple fix) and then prevail on Samsung to show goodwill, or present the bill to the administrators -Samsung may offer some goodwill, but I'd expect you'd be well down the pecking order on the creditors list with the administrators.

With this hindsight, you'll use a credit card in future (even if you apy the balance in full each month) and possibly a more reputable supplier. If it turns out the retailer didn't offer credit card facilities at the time of purchase, then this itself can be a huge warning in that the credit companies may have refused the retailer a credit facility on the grounds of poor history.

good advice thankyou. i have no idea who the administrators are, website just says down for maintenenace and phone goes straight to voicemail. It's the first time we've bought a product like this online and i googled the company and got good feedback

That's what many assume and for the most part, incorrectly.
Unfortunately it doesn't matter one iota if you think it hasn't lasted a reasonable amount of time. That would be for a court to decide.
Who would you sue though...thats your issue.

I would say you will either have to:
a). grovel to Samsung (but their repairs can be costly)
    b). learn from it.

If the company has gone bust, which sounds likely, then Samsung are your only port of call and they are not obliged to do anything.
