problem with super market

i have been having a problem getting a refund on a faulty item... this is the letter i have typed out, however i find it hard to write/type letters can you please tell me if you can make sence of it and what the problem is...plz no flaming
start of letter
Having bought a asus notebook on the 4th October 2009 out of your Cumbernauld store, and on the 13th October 2009 the item developed a fault.
Having still got the receipt, I went in to the Cumbernauld store to get a refund which I can get under the Sale of Goods Act 1979, because the store did not have any replacements, and I was met with the most ridiculous return policy that I have ever heard of in my life.
According to your returns policy you need to have the items original box, instructions and in this case set up discs.
You can not expect some one to keep a box, instructions and in this case set up discs for a whole year, just in case the item in question develops a fault. To even suggest some one do this is just the height of stupidity. Do you really expect some one to do this?
Having the store overlooking the fact that I did not have the original box, they then went on to say that because I don’t have the set up discs, I cant get a refund, even although the item is faulty.
Having called you “customer service” department on the same day and spoke to a ((insert name here)), about why I cant get a refund on this faulty item, all I got for about 30minutes was, that because I don’t have the set up discs I cant get a refund.
having ((insert name of CS here)) making some recommendations, like phoning the manufacture to get new discs sent out, then take the item down to the store to get refund, then ((supermarket name here)) will send the item along with the discs (which I would have just received from the manufacture) back to the manufacture, this recommendation just does not make any sense what so ever.
In order the get a refund on a faulty item I do not need the original box, instructions or in this case the set up discs.
In my experience ((supermarket name here)) is quite willing to take all your money of you with no problems at all, however trying to get your money back on a faulty item, you seen to be pulling out all the stops so this doesn’t happen, do you think this is fair?
I want my money back, I don’t want a replacement or to get it repaired, and maybe you want to review your ridiculous return policy.

What fault has it developed?
(as an aside, I keep all boxes, manuals, discs, packaging etc for everything for several years. It's clearly good sense)

I think you have the purchase date wrong.
I would expect anyone to keep discs that came with a computer for as long as they had the computer so that seems perfectly sensible.
Why do you not want a replacement?
You would not be entitled to all your money back0 -

The sale of goods act does not require the original packing etc and a simple call to trading standards will confirm thisChris Elvin0

I know lots of people that do - so we can move on from that.0 -
I think that problem is that the startup disks are not packaging, they are an important part of the computer, and as such have a monetary value. I don't think you will get a refund without them.
However, you should definately be entitled to a repair or replacement (they may remove the startup disks from a replacement unit for the swap).0 -

I have a loft full of boxes for everything. Helps if i want to sell anything on or if there's a problem down the line. Also insurers will often want to see boxes to prove ownership if you claimIt's standard practice

I think it will be the lack of the discs, which were sold as part of the original item, that will indeed be the sticking point
I agree, the OP purchased a package, including the computer and discs, but now expects a full refund on returning only part of the package.
I also keep all packaging for a year, so you are not alone.;)0 -
