Made to measure blinds

  • I asked for recess - and it is on the invoice I have to prove this is what I ordered. My worry is, now they have the blinds back, I cannot prove that what they sent was wrong. What would be my next step?

    Under the Sale of Goods Act, as I understand it, the onus is on them to prove the blinds are correct. They can't get away with claiming they adjusted the measurements if the blinds are the exact measurements.

    On the other hand, it does sound as if they at first accepted that they would have to refund you, and then when they received the blinds they changed their minds. Measurements are tricky. Maybe telephone them and ask them to explain?

    If they won't or can't explain, Consumer Direct could advise you on how to remind them of their legal obligations -- www.consumerdirect.co.uk. They have some templates of letters you can write.

    I agree - call them to find out what they actually think the problem is.

    I would also re-measure your window recess that you wanted them fitted to and compare that to what you have ordered, just to double check before you phone them (it gives you credibility to, that you have checked).

    I guess then that as they did not take the "extra" bits off that they should, the blind would not fit into the space in the first place, being slightly too big?

    OP if they are too big, why can't they just trim you the excess fabric off and send them back to you?

    Roobyroo, I would send the company a letter (recorded delivery) along the lines of:

    Dear Sir <name of person> @ http://www.blinds-depot.co.uk/

    On <date> I ordered two blinds from your company, giving you the exact dimensions of my windows, and selecting the option for you to adjust them to fit the recess. Please see this option highlighted on the enclosed copy of my order.

    I received my blinds on <date>, only to discover that you had made the mistake of making them EXACT, and not to fit the recess as requested.

    As the goods were not fit for purpose, I request that either the blinds are re-made to my requirements, or that you issue me with a full refund of <amount>.

    I look forward to hearing from you within 7 days.

    If they don't reply, I would then send another letter entitled "letter before action", then give them 7 more days to refund you, or you'll take them to the small claims court to get your money back.

    Hi,

    When you measured the window width ... did you measure at top & bottom ... cause we found that our windows were not the same size at the top compared to the bottom .... in fact the top was wider .... so it was ok for us ... but what if it was the other way round for you?

    Maybe you measured the bottom, they adjusted, but the top is thinner, so blinds don't fit?

  • Thankyou for the letter template - I have emailed it today, and I am waiting for a reply.

    I measured at the top of the window - so at the head rail should fit - it doesnt! They havent adjusted the measurements for the blinds to fit in the recess.
