    Hi, yes I have had problems with this company, I am in the process of taking civil action against them, they are conmen, before they got my money they promised the world and frequently used the word "solicitor"! I will NEVER go down this route again (online) I will always go and see a local reputable solicitor, which I did do and won my case with an out of court settlement. All done in a matter of weeks.

    I had trouble at work with our general manager so I joined a Trade Union and let him know that I had done so by mentioning that I would need to speak to the shop steward whenever he tried to make life awkward for me. As far as I know all the Trade Unions have a legal department which will help members with employment problems at no extra cost, you simply pay your union fees each month. You don't have to vote, march or support new labour, you will also get special offers on insurance deals. When my problem was resolved (he took early retirement) I simply resigned my membership -- job done! My point is that you don't have to pay through the nose for professional help, and definately don't pay a penny to these online chancers, do they even show the names of their " trained " legal advisors?anyone can send you a form to fill in, it's what happens next that is important. don't get ripped off by the people who take your money to help you and then don't come through
  • Be warned about Action Tribunal

    I have paid over £1000 to action Tribunal and received very poor services in return. In fact they have not done any of their undertakings.

    By going through Tribunal Action to seek redress for unfair dismissal, the only outcome that look possible is me loosing my case.

    Not only have they denied me access to the respondent's witnesses statements, my complaints has been completely ignored. I cannot go to another legal representative as Tribunal Action has the bundles and the respondent's witnesses statements.

    Can anyone advise me how I can redress. Will the Employment Tribunal be able to order them to hand over the documents or do I have to go to a different court?

    Most of all be warned of Action Tribunal (aka Cowboy). Tell your friends

  • I had all these problems. I paid nearly £1100.00 on the assurance I had a "really strong case" and all that baloney when in reality, I didn't.

    I tried their complaints procedure and, like everyone else, spent months getting nowhere. So, I filled in a County Court claim form and e-mailed it to the Service centre. Within a day I was contacted by Tribunal Action's solicitor who promised to investigate my complaint. Eventually she agreed that I paid out the money under false pretences and agreed for it to be paid back. This took about three months and necessitated me constantly phoning and chasing her (I had her direct line number) but in the end I got my money back in full!

    Just goes to show that persistence pays!

    I got sacked unfairly trying to pay a remrtgage and work a job with muscle injury from a bicycle accident someone else did t me and the BIG company did not stand up for me to the third party employer who I did my usual best work just as good as a normal working person. SO this caused loss of house and £35,000 in debt not to mention loss of three years work unemployed.

    So I tried a tribunal and I had a very heavy letter from the BIG company paralegal saying we will charge you ten thousand pounds if you lose the case for expenses.

    I think you should move on and forget tribunal system.

    Let us hope there is a God who judges.;)
  • Hopefully my recent "experience" will help some others..... firstly I'm more than slightly embarrassed at being potentially caught out by this unprofessional outfit as I am in fact a Trading Standards Enforcement Officer myself. My ongoing dispute with my local authority employer was dragging out and I wanted some help to rectify it. Being at the end of my proverbial tether and having what sounded like a very knowledgeable person (Angharad Boyd) offer to take that worry from me, I agreed to go along with it.

    Consider though... just how stupid does that make them? They knew what my job was and, whilst my professional status shouldn't mean I am treated any differently, they sure as hell knew that I would be aware of my rights and how to exercise them...!!!!

    Anyway, after a few communications and developments, phone calls always being returned immediately, emails responded to etc, I paid my £247 and agreed to go ahead with the service - which in my case was exercising a grievance which would ultimately (apparently) result in a financial settlement agreement.

    however, in completing the online "questionnaire" I was getting fed up with it bouncing back to me with "on hold" status, apparently due to my failure to complete it exactly as they wanted - although I had not been advised of this. When they came back by email and said that it was "on hold" until I had resigned as they could not proceed whilst I was still employed, I started to lose my patience - I had detailed discussions regarding this and my agreement to contract their services was specifically on that basis. Failure number one on their part.

    I emailed back to this effect. No response. I started trying to telephone - contrary to the prior excellent communication, calls were now not returned and then I couldn't even get through the dire recorded message assuring me how important my call was to them.

    I took the decision to email every single contact address I had for them (and if anyone wants them, I will oblige!!) to advise that, "in accordance with the terms and conditions provided to me with their client care email, I was cancelling the entire service, rejecting the contract in full and as this was well within the fourteen days specified in their terms and conditions, I expected a full and immediate refund".

    This appeared to ruffle a few feathers, my first call to the office the following morning I did actually get someone and my request for an immediate call back from a Manager was complied with. However during this time I had received numerous "automated responses" to my email telling me I had to use the online complaints procedure and this could take up to 28 days to process my refund. Crock of crap!!

    I clearly specified that I did not want to make a complaint; were they interested in investigating the service issue they were more than welcome to conduct their own investigations and I would provide whatever feedback they requested to help their own quality systems, however in this case, because I was cancelling within the 14 days specified in their T&Cs, they were legally obligated to cancel the entire contract and refund my money.

    Familiarise yourself with the Supply of Goods and Services Act, contact your local Trading Standards service if you need wording, they can help you to construct an appropriately worded complaint or just give you the assurance that you know your rights before speaking to them on the phone.

    I was called back by Gordon Lewis, who told me he was the Operations Manager. He gave his direct line number as 01656 673299 and his email address as [EMAIL="gordon.lewis@fields-group.com"]gordon.lewis@fields-group.com[/EMAIL]

    I fought the good fight with Gordon and told him that I did not need to go through the complaints procedure, that as I was cancelling in accordance with the T&Cs I was entitled to an immediate refund and I expected it to be processed straight away. the "complaints procedure" apparently is used to determine whether or not your reason is good enough to justify a refund, however a consumer is entitled to reject a contract if the service is below the standard a reasonable person would expect or if the service being provided is not as you were led to believe it was, and such misleading information was the deciding factor in whether or not you used the service. So dear old Gordon actually didn't have the foggiest idea what he was going on about and I managed to tie him up in knots.

    He told me he would escalate the matter to his MD but the final authorisation was the MD's only - I once again advised him of my rights. After sticking to my guns, he agreed to process an immediate refund - then was reluctant to send me email confirmation of this. I advised that all communication had been done by email thus far, if he were genuinely wishing to rectify this satisfactorily then why would he be reluctant to put his assurances in writing.

    I got it in the end, although he emailed at first to say he would confirm he had agreed a refund. I went back and asked him to confirm, in accordance with our discussion, that he had actually processed the refund request that day and the refund should show on my account in approx 3 working days - yes I got this.

    Yesterday - just 2 working days after this painful discussion, I received the full £247 refund on my card.

    Make yourself aware of your rights under the appropriate legislation and stick to your guns. Providing you don't allow yourself to be pushed around or fobbed off, you should succeed and if you need to seek redress through small claims court, do so - and claim all out of pocket expenses/consequential losses too. It is also worth considering that if you paid on a CREDIT card, there would normally be an insurance cover so check with your CC company if there is any redress available through them.

    Im a HR Manager and have been on the receiving end of a letter from this outfit.

    We have recently sadly had to make a number of redundancies, and in the middle of the consultation process I received a letter from Tribunal Action UK representing one of my employees, stating that he had been made redundant, hadn't followed the correct procedure etc etc - no mention of the fact that the process was only half way through and at that point no redudancies had been confirmed. I felt incredibly sorry for my employee, who I asked into a meeting and asked why he had asked them to submit the letter and explained that at that time nothing was confirmed in regards to redundancies and the process was a defined legal process which they should have queried with him. He said that they didnt ask to see copies of any documentation which would have clearly shown that the process was not complete. He said that he was going to attempt to get the money back, but nothing has been forthcoming.

    It's usually a crappy enough time for employees when they feel they want to take legal recourse against their company without parasites like this company preying on people.

    Blade I notice you are in Sheffield, Fields Associates another of the Fields Group based in Bridgend don't seem to like Sheffield.

    They recently lost a court case they brought against a competitor who had exposed their data recovery scams. Seems the law can see through their BS and the Judge not only ruled against them but also awarded the competitor more than Fields had tried to claim from them, so much for Fields Digital Intelligence !
