i got a Samsung tocco from them in june/july on contract, the touchscreen has stopped working and wont power off, even if i take the battery out and put it back in it just goes on automatically. Hasn't been dropped or near water so i returnd it to shop who sent it away, checked online to see whats going on with it (as have no way of contacting them) to find its being returnd and they cannot fix it, surely im in my consumer rights for them to fix the problem ? and if they say it was damaged is it there word against mine ?

If it cannot be repaired due to manufacturing faults, it should be covered under a 12 month warranty so a refurbished or new phone should be sent out.

If they put it down to water damage you are stuffed. A sticker inside changes colour due to moisture, so even if water is not a problem and the sticker changed due to just sweat in your pockets. They won't care to investigate further or fix it.

If you do not have a phone, the contract will continue and you will need to acquire a new phone. No phone is not a valid reason to cancel if your wondering.
