    Precisely some companies sick pay polices are confusing as they state you get x days on full pay followed by x days on half pay and then no pay. And this varies from what group you fall in.
    I'm not cynical I'm realistic :p

    Nope.

    Not likely.

    All they would notice is if they hadn't been paid and wonder why.

    Anyway stop trolling. If you want to attack people there are other boards where people aren't as sensitive.

    Follow the advise so far, ask them for a breakdown and evidence. ie. where in your contract say that you don't get full pay sick pay, etc. If you still disagree that you've not been overpaid then you should put your disagreement in writing and explain why. If you've been suffering with work related stress you should explain how they have caused this.

    The process your company is like to follow is one of debt collection. They will write to you and ask you to repay (sounds like this is what they have done) have they given you a deadline? Then after that deadline expires they'll write again with a final deadline. Then they'll start court proceedings, but remember these are expensive and time consuming for the company.

    So if you agree that you have been overpaid you should offer a repayment plan over a period of time based on what you can afford.

    It's not like they paid an extra grand on the salary each month, this sounds more like the employer saying that they paid full pay on sick leave after their policy said they had to. Well employers have a discretion to pay sick leave for as long as they like and it would seem reasonable to expect that if they were paying you when off sick that's what they were doing.

    Also, it was work related anxiety and depression; did they have you sign a compromise agreement when you left waiving all claims against them? If so that normally stops any employer making any future claim against the employee as well as the other way round.

    If not, the hint that you might have to consider further action against them for not preventing your health problems might get them to drop the point.

    Get a breakdown of what they claim is owed, and then go to the CAB or get a free half hour with a lawyer.

    I am not a lawyer, and I don't know if this would work or not, but there's a legal principle called estoppel which means that if you end up disadvantaged because of somebody else's action or mistake, you're sometimes protected from being sued by them. It's about fairness. If it was reasonable for you not to realise you were overpaid, then you might be covered.
