Natwest Charges

I had my claim for hardship declined because i had around £40 free cash every month, which they say can be used to pay prority debts. When i submitted my claim i asked for further charges to be stopped on my account, which they were not stopped. Being sick of getting charged for silly things i switched my account to a different bank. 4 weeks down the line i recieve a letter saying another of my Natwest accounts is £323.61 O/D. This is made up purley of charges as i do not use the account as when i opened it, was not aware there was a monthly charge of £6.95. To cut a long story short, i refuse to pay these ridiculous charges the person on the phone told me the account will now be marked as DEFAULTED and passed on to a DCA. Can i still put in a claim for these charges back, like on my main Natwest Account?

Help or advice will be greatly appreciated

    Yes and you should ask them to downgrade the account from an Advantage Blue account to either a step account or a current plus account. Furthermore, I would offer them token payments of £1.00 until the conclusion of the OFT test case issues simply because they have the right to send the account to debt collection even though you can tell the DCA that the account is in dispute since x date with regards to the bank charges.

    I would do it in writing but that is a month or £10.00 if that is something you can afford but yes they can refuse it.

    Thanks for the advice, shall write them a lovely letter now. Wish this test case would hurry up and win it for all us who are owed money!!
  • Ok in regard to this post, i recieved a letter back from Natwest declining my offer of payment of £10 p.m till the outcome of the test case, they are demanding £60 pm. I no longer use natwest apart from one DD, this morning i logged onto my account and noticed my account had vanished from my account list. I rang natwest, the lady on the phone was as helpful as she could be, telling me my Account has gone into Debt Management. but this account was in credit which is very confusing! and the one they are asking for £60 P.M is still there. I have a DD due out tommorrow, which obviously wont get paid because they removed my account, also i transfered money to the account to pay the DD which i dont have a clue what is going on with!!

    Can anyone make any sense of this till i rng the Debt people at natwest???

    To be totally honest I would have cancelled the Direct Debit and would not have had any money kept in one account with the other one in minus figures because the bank can offset the money from one account to the other.

  • Called Natwest again, they had put a stop on my account because of the amount overdrawn on my other account. They confirmed they were taking Legal action to recover the £380odd that the account is in debit. they refused my offer of £10pm till the test case result came, and said they want £65pm which is totally unaffordable! Why cant they just pay the charges that they owe me like this!!!

    Tell them to sue you because you will defend it on the basis of the charges that are owed. Make sure that the amount is higher than the amount they say you owe.
    If they send it to a Debt Collection Agency keep telling the DCA that the debt is in dispute with the bank and they can do nothing and you will pay them nothing. Furthermore, pay £1 per month into the account every single month because you offered and they rejected but you can keep paying into the account while it is disputed.

    Thank you for your advice NWSM, My partner is getting worried that they are gonna default it and affect my credit. So when i get letters from a DCA just write and tell them that i am not going to pay? I shall transfer £1 right now!!

    Tell the DCA why, ie the amount is in dispute and you are dealing with the bank.
