PAYPAL - downgrade from Premium to Personal?

I think the confusion arises in the fact that ebay and paypal have slightly different terms and conditions as of course paypal can be used on sites other than ebay.

However, Jenniferpa is quite correct in that the ebay t and cs are quite clear on the 'penalties' that might be imposed should a seller tick the 'I accept paypal' box and then refuse a payment via a card.

A seller may not:

Refuse to accept a buyer’s PayPal payment using a credit card if the seller included the PayPal logo in the listing which signifies the seller will accept PayPal payments. Sellers are not permitted to state in their listings that PayPal payments made via credit card will not be accepted.

So Ebay are incompetent and have two webpages that contradict one another

No, http://pages.ebay.co.uk/help/sell/paypal.html specifically refers to selling on Ebay, and it is on ebay.co.uk site

Ah, but mine has penalities and your's doesn't!

I would agree ebay's T & C's seem almost purpose built to confuse the unwary.
