    We noticed all that m8.... in the 12 weeks we've been at this so far.
    There have been many house comps online that failed to hit target and this one may join them...but it's free and even if it falls waaay short the prize will still be somethig worth having.

  • In addition, if you look closely they claim to have trademarked https://www.winahouseforfree.com as they have placed a small "TM" next to it.

    However, the IPO appear to have no record of any such trademark in their database: https://www.ipo.gov.uk

    tbh as soon as you have written something or called something something you are entitled to claim ownership if you are the first to do it. so can put the TM sign next to it. You dont have to register it as far as I was aware.

    could be completely wrong on my understanding of course !!!!!! and Im sure some one will come on and put me right :rotfl:

    As timmmers says - got be in it to have a chance to winning it havent you - so we do.

    Its quite shocking though when you see the days go by and you realise you have done this every day for that time!!!!!!!

    but if there is a sniff of a reward at the end then majority of us lot will go for it wont we.

    They didn't need to register it for several reasons, the domain is theirs for a start so why would anyone else use that name as a trademark, the logo isn't anything artistic and doesn't need it..but if it was it's like any image created (logo, photo etc) and the copyright belongs to the creator.

    The trademark doesn't relate to the name or logo here though, if you read the site they have patented the system (Which I find totally hilarious considering it's mostly a script by someone else and that it's not exactly user friendly or reliable is it?).

    They also seem to have a couple of other domains relating to this, and have stated an intention to do something else after this ends...no details yet on that though.

    I still think that they get an idea, blow it up in their heads into something wonderful...then go for it without very much deep planning or thought. The figures look way off, and the visitor numbers...well they would scare me to death.

    A really well thought out databse driven site and some hard promotion would have helped I think...so would a reliable internet connection (why the hell they need that computer shop for any of this and have such email problems?).

    After about 100 days I'm not stopping now when it's free and so little effort...and I'm interested in seeing how it all pans out. Hopefully with an MSEr benefitting.

    They might not need a Trademark but they are claiming they have one as thet have put "TM" next to the winahouseforfree.com bit. Claiming to have a trademark when you haven't is very naughty indeed, if not illegal..

    They claim to have applied for a patent (Note that this hasn't been granted)

    I hadn't really thought about the ISP problems and the fact that they appear to use web access from their local computer shop to select their winners! Now that really has started alarm bell ringing in my mind!

    I agree though, the idea *could* be made to work and it could work really well. Problem is it's been very poorly executed.

    As you say, the average comper has very little to lose. The people who will feel hard done by if all this fails are the advertisers. They are paying well over the odds for not a lot of traffic at all..

    A Trademark must be registered with the Intellectual Property Office to be a legal trademark. I think you are thinking of copyright.

    They cannot be paying much over the odds as their total spend is not going to be much. Look at the some of the advertisers websites and then estimate their likely advertising spend, in most cases I doubt if it would be more than the occasional £50 for a spot in the local rag, a proportion of this is probably now going to the comp site but none of them will be spending £100's a week on advertising. I guess they are raising less than £500 a week and will gross under £10k for the 21 weeks of the competition.
    Still it's free to enter.
