Paypal want proof item is fake

Wonder if someone can help?
A friend of mine has been sold a fake Karen Millen dress ( obvious by the fake tags and finishing of the garment - as she has now gone to the shop and bought original and done side by side comparisons)
Paypal want written proof that the item is fake within 10 days or they will close claim - Karen Millen are not interested in providing any note of this kind ( why would they??), although they agree in shop, that it is a very poor copy.
What happens now?? Would you just email paypal with photos to compare x 2 garments? or just give up and let the rip off seller win?
Yes, she can leave a neg, but she is £80 out of pocket
any help in similar cases etc would be appreciated?
thanks x

Unless you can get a letter from a dealer or the company confirming its fake she will lose the claim. Paypal will not get involved in comparing items. You could contact shops etc who supply that designer.0

KM manufacture their own clothing - but since they moved most of it to China, ebay is 80% full of fakes. I cant believe that the buyer is not protected! She would have been better off to have said it had a hole in it instead? then SNAD?t0 -

The buyer is protected she just has to prove its fake. I would think KM would want to get fakes removed from circulation as it damages there brand so it would be in there advantage to write confirming its fake0 -

I'll tell her to write then, but doubt that she could get a response in such a short time.0 -

my friend has spoken to paypal who said they need written confirmation from km. Spoke to karen millen who say they will not put anything in writing as it leaves them open to law suits from ebay.email???????
She spoke to ebay who said nothing to do with them - its paypal.
Paypal then suggested she goes to the police - waste of time.
one big circle - round and round
So if your into making money - sell fake karen millen! the worst that could happen is you'll get the odd negative feedback.0 -

I'm surprised the company do not want to issue a letter to enable you to get your money back from paypal.
My DH bought an 'Apple' adapter from ebay and surprise surprise it didn't work. Luckily we have an Apple Store in town so I took it in , they checked it and said it was a very poor copy. They ordered me a real adapter and also printed out a letter telling ebay/paypal that the item was a very poor counterfeit copy which did not work. We took the matter up with paypal and ebay as although the seller refunded us as soon as my DH left negative feedback after we got the refund he tried to say we hadn't paid and demanded further payment! After telling them we had been in touch with the Apple store and had written evidence from them they took the black mark off my DH account but they never actually asked to see the letter, which I thought was bizarre.
Keep trying with ebay/paypal and write to the head office of Karen Millen. I have to say I'd never use ebay again as it just seems full of dodgy stuff, how you can tell you are getting the real mcoy I'll never know. I know people who use it and always come up trumps but its not for me.0 -
I'm struggling to see what's in it for Karen Millen (or any other business) to devote resources to writing letters like this.
I know I sound unsympathetic to the OP and I'm sorry about that but seriously, what's in it for them?0 -
Not saying this is the case here but....
An old friend used to be a manufacturer for a 'top name' and told me once that he was 'entitled' (presumably written into some sort of legal agreement) to sell off a certain percentage of what he manufactured i.e. seconds/sub-standard via his own factory shop. No ideas how it worked but it did cause a 'few' probs as a customer once bought a garment from his shop for just over £100 and then took it back to Harrods and got a refund of £500+!!
Obviously, lots of scams around and who's to say who is actually responsible? :rolleyes:Make the most of everything in life (especially Avon
