Car park under seige - advice appreciated

  • Thanks for advice. Re PPP Lasers suggestion as previous clampers will clamp anyone - it's how they make money - and the managing agents are advised that once the clamping genie is out the bottle it's very difficult to get back in. Re the barrier as prevous - great expense and definite disruption. Nexuss I will advise managing agent to contact your legal expert tomorrow and many thanks. It would seem that the residents will probably have to incur considerable expense and inconvenience to stop the "I know my rights" brigade parking at their expense.

    great expense

Not so sure about that - probably get the thing fitted for 5k - amongst 100 flats, that's £50 a pop - sounds bargainous for an extra bit of security and better parking.
  • Thanks for suggestion but the true cost is nearer 20K with ongoing management/maintenance costs. Yes the gates, pillars, lights, road markings, motor units, power supply, back-up power supply etc do come to about 8k. Then a phone/remote activation system needs to be installed allowing visitors to be let in by residents plus zappers to be issued to all residents/regular visitors. It then becomes a management challenge with changes of residents/tenants and individuals losing zappers and flat batteries etc. All of this expense and disruption because it would seem the law abiding resident has no rights compared to the callous and informed parasitical fly parkers.

Simple solution is to put a key ring onto the zapper and tell them to attach it to their car keys. If they lose their car keys they can't drive anyway so could not complain they lost their zapper and cannot enter. Also suggest that a fee be charged for lost ones that would cover the cost of the new one and compensate the person responsible for issuing a new one. Regarding batteries, most car keys need those now anyway for remote central locking so if they have difficulty replacing them no doubt a key place would swap it.
  • Thanks for excellent suggestions anewman. All good ideas but there are many more additional issues to be considered. And of course the fact remains that the innocent residents will be saddled with a bill of 20k plus with considerable ongoing costs. All because of the parasitical parkers who care for none but their own as far as rights are concerned.

As an aside I have read literally thousands of words of advice as to how to ignore private parking enforcement but can find precisely none on how to rightfully enforce it.

I think the only option is a private action on grounds of tresspass .... and that's action that only the freeholder can take, not the residents as it's not their land being tresspassed on.

And action would need to be taken against each and every tresspasser, hopefully resulting in an injunction. But that won't keep "the next tresspasser" away.

(This is why the advise is to ignore the "fines" that PPCs dish out - as the remedy in law is not a fine!)

The only really viable option is to put them off parking there in the first place - and I think most options have already been explored. Cheapest would probably be the clamping company - but then you would have to issue permits for all those allowed to park, otherwise legitimate users would be clamped too!

I sympathise but can't offer anything useful - sorry
    Warning ..... I'm a peri-menopausal axe-wielding maniac ;)
  • Get some signs made up, private parking clamping etc etc..

Then fit a couple of clamps to your own cars, nice and early in the morning.

If i drove into a carpark like that i would soon be reversing out.

Just need to hint at clampers in action, Would be even better if you get someone to stand near the car and pretend to be on the phone to said clampers.
Im sure your spaces would soon re-appear.

Maybe even a clamp chained up to a drain pipe on view at the ready?!

You have an automatic barrier on the way in and a coded barrier on the way out. So nobody has to do anything to get in, but people have to be told the code to get out. Easy.
