Hello,
Today, I took out a new contract with Orange through Phones 4 U.
My questions is, can I return the phone and cancel the contract?

There's no cooling off period for anything bought in store as you have the option of trying it, so technically, no.
What's the problem with the phone ?0 -
Legally no, cancelling is at the discretion of the store manager / operator. Legally you only get 7 days for internet purchases.
As above, what is wrong?Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
When I took out the new contract, the sales person told me they will pay off 2/3 of my remaining contract. After I signed, they told me I would need to trade in my old mobile phone for £30.
I feel I have been miss-sold this phone and there's nothing I can do about it.0 -
If you feel you have been mis-sold get in touch with your local trading standards office - http://www.tradingstandards.gov.uk/extra/contact.cfm?frmAlias=/contact/.
Also, read any documentation they have given you. Does it state they would pay your old contract / take your mobile. Often these places will take any old mobile for £30, upto £100 for newer ones. But I've never heard of them paying off a previous contract.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

The sales person first said they will pay off 2 of my remaining 3 months of my contract off, then she said I would have to trade in my mobile phone for £30.
She suddenly changed her mind!0 -
That would still be a verbal agreement between you and the shop, hard to prove thou.
So just to be sure.
1. You went in for a contract, they offered to pay off 2 of your 3 remaining months.
2. You signed up.
3. Then she states you have to trade in your old phone as well?
Where did she change her mind? Is she no longer offering to pay of the remainder of the contract?
Failing this, most networks to have a 7/14 day cancellation period but is it good will and not a legal requirements.
Applies to online orders but maybe worth giving them a ring - http://www.phones4u.co.uk/help/help_terms.asp#tac10Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

The 7 day cancellation policy doesn't apply, and Orange have no say about cancelling the contract, its down to Phones4U, and in my experience they don't know the meaning of the word goodwill0

The sales person said I would only get £30 if I trade in my old mobile phone, instead of partially paying off my old contract.
I've already rang Phones4u and they sated, from 7th August 2009, they no longer accept returns, unless the goods are faulty.0 -
Go back to the store and say that you took out the contract on the verbal agreement given by the staff member that 2/3 off your existing contract would be paid. And if this is now no longer the case then you will not continue to take it out and that you will pursue further advice from trading standards.
Sales staff say alot of things to try and make you sign.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
