I'm in the process of submitting my tenants deposit to the DPS. I have 4 tenants and i've asked them to decide amongst themselves as to who the lead tenant will be with regards to dealing with the deposit. They still haven't let me know and i have 4 days left to submit- they say they work long hours and haven't had a chance to discuss it with each other. Im worried because i haven't fulfilled my legal obligations until the depoist submission happens. The other thing is i rented the property through a 'let only' via letting agent and they held the deposit for 9 days before giving it to me with the 1 months advance rent - so would the 14 day deadline start from the deposit being given to the agent or me?

Deadline starts from when the money was given to the agent. Any interaction with the agent by the tenants is done fully and entirely in your name.
As for lead tenant, write to them and nominate the first alphabetically, or whoever you prefer and give them the option of accepting or notifying another name within your deadline.Hi, we’ve had to remove your signature. thanks for the replies. Would i need to formally write to my preferred tenant or can i do it verbally? Left a message this eve and no reply from the tenant!! So fustrating! If i get the deposit submission done within the next few days will i still be open to litigation in the future by the tenants as i've missed the 14 day deadline even though the agent had hogged the deposit and the tenants are taking ages to decide as to who will be the lead tenant? Sorry if i sound naive but this is the first time i'm letting out a property...this is a lesson i won't forget0

Honestly, just write to them and say what you've said to us... explain that you have chosen the "lead tenant" alphabetically and if they have a problem with that they can write to both you and the deposit scheme people themselves.
You can change the lead tenant at any time.
Being lead tenant really means very little, I got a nice big cheque back off the deposit people but it had to go straight down on the next place, don't stress about it and just do it alphabetically, they can't be annoyed with you for being logical.I run an event management company, I put on events, I go to events, if I don't know anything about events - its not worth knowing!:j:j:jNegotiate, Negotiate, and Negotiate again.:j:j:j0 -

- Address your letter to ALL of the tenants, it affects ALL of them and they ALL need the option to dispute your choice.
You are going about it the wrong way. You are still trying to get them to choose. But YOU choose and YOU tell them and THEY either accept or come back with a different choice. Tizhimi says lead tenant can be changed at any time. It is more important just to get on with it, choose, put the money in the scheme and deal with problems later.Left a message this eve and no reply from the tenant!! If you are a newbie landlord some tenants will spot you a mile off. I think you need to join a landlord's association and start getting up to speed on your rights and responsibilities.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0 -
I suspect the tenants are dithering as they're not sure what obligations the lead tenant has. Protect the deposit using the suggestions above and then they can "dither" all they like. But at least their deposit is protected and you have complied with your LL obligation in this respect.
It's no big deal for the lead tenant - they just don't realise that.Warning ..... I'm a peri-menopausal axe-wielding maniac
