    Talk to her before you commit to the IVA. You are married so she should have some input into the decision as to what you both should do to resolve this problem.

    Present her with options and issues, yes, but not a done deal.
    Debt at highest: £8k. Debt Free 31/12/2009. Original MFD May 2036, MF Dec 2018.

    Your IVA company will want to know your wife's contribution to the household budget in order to work out a fair budget and rate of contributions for you, so you will need to discuss this with her.

    As far as the 75% rule goes, yes, MBNA do own more than 25% of the total debt so could in theory put a spanner in the works. However, the IVA company will do everything they can to sell this proposal to them, and any arguments they may have will be discussed and negotiated through with a view to getting the proposal agreed. Remember the IVA company is not going to do a load of work drawing up and submitting an IVA proposal if they can't see it being accepted!

  • Oh yeah, I will defo talk to her before commiting to IVA, but just wanna speak to the IP from PayPlan who just go over everything and say if he thinks it will go through (they are calling me tuesday)....that's when I will finalise things with my wife......was supposed to talk to her last week but she's been down with flu so had to wait till she's better. Did tell my parents though who are very supportive.

    Well done on putting your parents in the picture - it's not so bad when they can see you are trying to do something about the problem. Hope the call with Payplan goes ok on Tuesday, and that you sort things out with your wife. Then you can both make a new start.
