Capital one keep phoning

Hi
I sent off the letter to Capital One on 28 September to request that they don't phone me any more and only contact me via the post.
But they have phoned me again today at work, told them I was off sick and asked if anyone else could help and the woman said that I should ask *** to phone Capital One.
Is there a template letter that I can send again to them.

Well, Capital One have phoned again just now.
Ask them if they had received my letter telling them to only contact me by letter, to which the wee woman relied that I had to answer the security questions before she could verifiy that they shouldn't be phoning me.
Told her that they were in breach of the law and that I was now going to report them to OffComm and the Office of Fair Trading, her reply was yes, but could you answer the security questions!!!!
Repeated that I was going report them and said good-bye.
Any one got a template letter to that I could use to write to Offcomm please.

Yep, if you don't answer the questions then they have to write to you. Thats the other way or convincing them to write.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
I think it's the financial ombudsman you need to complain to not Offcom - I beleive they have a webpage - but not sure.

You made me think of a cunning plan;). Next time they phone, I think I'll put them on hold for a while and then when I go back to them just not answer the security questions. After all it's their phone bill.

Thank you for your letter dated xx/xx/2009 the contents of which are noted.
In your letter you make reference to requiring my signed authorisation /specimen signature** before you comply. I draw your attention to the fact that no signature is required for my request of information that the account is closed.
If it is for Data Protection purposes then i can happily supply you with documentation to substantiate my identity to you.
However please note that to date you have happily sent statements and correspondence containing extensive sensitive private information to my address. I have to ask if you are concerned that you are corresponding with the correct person why has it taken so long to raise this?
As you are aware, disclosing data without adequate checks of identity is contrary to the 7th principal of data protection, listed in schedule 1 of the Data protection Act 1998:
7. Appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.
I note that there is no provision that removes the requirements of the act to provide this information, even if you are unsure of my identity.
I look forward to receiving the documentation requested

Well Capital One are still phoning me everyday but only once a day now. When I tell they that they have received my letter stating that all correspondence should be in writing they hang up so I suppose that's some progress.
Think I'll have to make a formal complaint now to Capital One and copy the financial obs. in too.
