Vodafone Contract Renewal Query
I had been contacted by Phones4U 60 days in advance of my previous mobile contract ending in July 2008 when I accepted an upgrade onto my current mobile deal with Voda on May 13th 2008.
The contract quite clearly states it is an 18 month contract from that date and as such I thought I was free to leave on 13th September 2009.
I contacted Vodafone to discuss my retention contract to be notified via the automated message that my deal is due to expire on Nov. 13th 2009 which I found to be at odds with my belief.
I discussed this with their customer advisor and he then told me that my contract does not expire until 13th Jan. 2010 as I had to honour the two outstanding months on my previous contract as well as the 18 months on the upgraded contract. :huh: :huh:
Can anyone advise what the legal position is on this as my contract does not mention anything about serving out the previous contract?

If you upgraded early (say 16 months into an 18 month contract) then the extra 2 months are still part of the contract. so 18 months plus to 2 month left on the old contract.

Just because you agreed to upgrade early, it doesnt mean you are going to be let off the remaining two months commitment on your previous contract.
It was an 18 month contract and not a 16 month contract. You have to honour the entire agreement.0 -
Thanks for the replies but that was not made clear to me at the outset and there is no mention of it on the paperwork which I find rather surprising.

What contract was this - Voda or P4U? Can you reproduce the wording for the forum that you say is perfectly clear?
The other advice given would seem to be correct inasmuch as early renewals usually are tagged on to existing contracts, but if you have any wording in writing that states the contrary, then you are on pretty strong ground to take it further with the other party to that contract.
But don't cherry-pick, and by that I mean if you have other wording from the network that says different as well as the bit you refer to, then that would be a different ball game.0 -

The customer agreement is with Vodafone.
I have just read the Customer Agreement again to check and it states :-
Contract Duration 18 months and is dated 13th May 2008
I have also just noticed on another line on the agreement that it states:-
Contract Commencement date: N/A
which is probably what they are using as their method of keeping you with them for the 18+2 months.
The confusion would not have arisen if it had stated the contract end date.
