1st time LL

Hi

I'm a 1st time LL & going to be putting my tenant's deposit into the DPS and know i need to serve them with the 'prescribed information' document. In the document it asks for any 'circumstances when all or any part of the deposit may be retained by the landlord' and to put down clauses from the tenency agreement where this applies. Silly qs-but is this any clause in the tenency where it says the tenant needs to pay/compensate the LL for any damage to property/breach of obligations? thanks

    Yes and the only clauses that seem to be related are those where there is any damge, loss etc to the property e.g

    'To pay and compensate the LL for the reasonable costs of any breach of those obligations It is agreed that this sum shall not be transferable by the tenant in any way and at any time against payment of the rent and that no interest shall be payable on this deposit.'

    'To immediately pay the LL/agent the value of replacement of any furniture or effects lost damaged or destroyed..'

    'To replace all broken glass in doors & windows damaged during the tenency'

    'To pay and compensate the LL fully for any reasonable costs expense or damage incurred or suffered by the LL as a conseqence of any breach of the agreements..'

    There isn't anything where it specifically says where the deposit (or part of it) has to be retained. The tenency agreement was done through a letting agent. I opted for let only. Due to the above does it appear they have missed anything out in the agreement with regards to the terms and conditions of the deposit?? . Thanks
