Ive ended up with 2 iphones!

wondering if anyone can help!
I was previously with orange for my mobile and i have since changed to o2. My old phone is completely broken and i was stuck without a phone for over a week so when i noticed the carphone warehouse was despatching iphones this week i ordered one last wednesday and i paid £45 up front! (not a clue what that was for but didnt question it) So i got an email to say i would get it the 8th or 9th! So of course i couldnt wait when i saw that o2 had them in-stock and waiting to be despatched!
I called o2 on friday morning (the 2nd) and ordered one through them as i thought well i would rather be through o2 direct rather than the carphone warehouse and i would phone and cancel the other one as they would not even be despatching them until the week after - O2 told me just to phone and cancel as they would do it no problem!
I got a phone call at work on fri afternoon from my mum to say there was a parcel there for me and it was from The Car..... !!! So i went home all excited and ripped it open immediatly and started playing around with it. I called o2 back and told them i wouldnt need their one and they said it was too late it had already went to the warehouse, just to send it back when i got it on tuesday!
So today the one from 02 arrived! Question is can i send back the car phone ware house one? and keep the o2 one?? I have played about with car phones one all weekend, but i think i would rather be with o2 directly rather than the other?
Can i send back the one ive been using for 2 days??

no. you will have to keep the one you played with. once you set up a phone and use it you have accepted the contract. if youve used both your stuck with paying for two contracts0

Actually I was told by a vodafone rep that even if I had used the phone provided it was in good order, etc I had 14 days to change my mind and return it. It might not be the same for all companies but it would be worth contacting them to find out.0 -

similiar here,
i upgraded for my sister recently through orange and i was told that i had 7 days to return it if i wasn't happy with it and that she could play around with it and get used to it!!!!
don't distance selling regulations apply to this????

DSR applies - but I fail to see why a company should be stucj with a second-hand phone because you are too impatient to eait for delivery.0

o2 have a 1 day money back anyway even if the handset has been played with.
It will be better to send the o2 one back, CPW are terrible for forgetting to do out of 14 day ceases of contract, your customer care will still be handled by o2.Work like you don't need money,Love like you've never been hurt,And dance like no one's watchingSave the cheerleader, save the world!0 -

Return the 02 one as you haven't played with it.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Hi everyone,
thanks for your responses! I wasnt sure what to do so i called CW (before i even touched the o2 one!) and they said just to send it back! They have the 14 day thing and he said it doesnt matter if ive played with it all weekend ive just to take my stuff off it and send it back by recorded/special delivery and they will even refund up to £10 for my postage fees. I asked if he was sure i would be totally out the contract and not required to exchange it for another phone and he said no, that would be me out! I have to call back within 5 days after posting it to double check it has been cancelled, but he says all calls are recorded so not to worry about anything he has said.
