Police were involved with regard to her taking pics, she was given a warning by them, but she stated that she was merely gaining evidence in her case for the Tribunal she took us to a few years ago on the basis of 'lifestyle inconsistent with declared income'.

I can't say what type of PWC you have - from what you've said she sounds like a stalking nightmare.

However, her reason for the photographs do ring true - basically if she makes an accusation against you then she has to provide evidence, so if your son goes to a private school then her say so is not enough for the CSA to do anything, she has to show that he does actually attend. Likewise if one of the children mentions you have a brand new car, just mentioning it to the CSA is not enough to trigger any kind of investigation, she has to prove that car is yours.

It's one of the most disturbing and unsavioury aspects of the CSA imo. If say a person is claiming they don't work but the PWC knows they do - then allegations should be made, the CSA should investigate in the first intance writing to the NRP and asking for their response to the allegations. If the two stories do not marry then the CSA should investigate. Same with an NRP who is not sure if their child is still in full time education.

I feel it leads to normal people having an unhealthy involvement in their ex's lives - not nice for either of them, it puts the children in a difficult position and it makes them feel they are 'grassing' on one parent or the other and for some people it could induce a full blown obsession in the other person's life.

  • I know what I would do if our pwc ever took pictures of my children;) She certainly wouldn't take anymore!

I don't think there's anything you could do though  She would have a reasonable explanation as to why she was doing it and it's not illegal to take pictures of people without their knowledge - tons of photographers do it all the time.

In the same way that if, in the future you needed to prove that one of her (and your hubbies :)) children was in work you might need to take a picture of them going in and out of somewhere on a regular basis.

Just telling the CSA wouldn't cut it and they would take no further action, as long as child benefit is claimed they don't care, child maintenance is still payable.

That of course, doesn't mean that the photographer is actually right - in bdt1's case - someone else paid the private school fees, in my mythical child not doing further education, they might have a part time placement and still be within the rules of being within further education.

I would never take pictures of someone else's child unless their parent had said it was ok to do so. If we thought she was lying then we would go down the solicitor route of getting letters sent to her etc but I certainly wouldn't take pictures of her children (but then I am a normal person not a crazy stalker:rotfl:)

I think our pwc knows that there is nothing I wouldn't do to protect my children and I think she is wise not to push me past that limit;)

Agreed though that the csa don't help but allowing you to do this:rolleyes: although because they are children I bet there is either a criminal or ciil action you could take against someone taking pictures of minors without your consent.

Not allowing you - almost forcing you, look at any site about non paying NRPs and see how much of the advice revolves around hiring a private investigator. The other option is to just give up.

Again, I'm not making any judgements on the NRP here - if the PWC mistakenly perceives the NRP as earning more than they do and they have some anecdotal evidence that backs up their beliefs, then the CSA gives them no option but to look for further evidence.

I'm always happy to be proved wrong but all I can find is things like this

    http://www.telegraph.co.uk/comment/personal-view/3559975/There-is-no-law-against-photographing-children.html

    from the article
Afterwards, I rang the Home Office. They assured me that there is no law against taking photographs of other people's children, provided you do not harass or harm them.

  • That is absurd, considering that people have to be very careful nowdays with taking pictures of children etc that a complete stranger could take pictures of my children and be allowed to do so:mad:
Maybe more of a civil matter then. If I was there I would certainly at the very least smash her camera up.....and that is the very least I would do;)

I would also feel the same about the nrpp taking pictures of the nrp and pwc's child/ren. If the nrp wanted to take pictures of their own children then that is up to them.

What a mess this country is in:eek:

How many celebs get into trouble for damaging photographers equipment? ;)

At first read I thought "I wouldn't be happy with people taking pictures of my children" but then thought of how many children I've captured unintentionally in the past when taking photos or how many strangers photos me and my children must be on lol

  • Yes I realise this but as I said they are my children to protect. We have had a harrassment case against our pwc already so I am sure having already been told to keep her distance and to keep away from our children our pwc would be in alot of trouble if she did this. As she comes from a pretty bad family the police have dis-believed all of her existing stories so far so i'm sure they would take our word over hers;)

I don't have a problem with people innocently capturing the children on camera but I think that is very different to going out with the intention of photographing someones children.

It depends what purposes they would be doing it for I suppose. The obvious, I wouldn't be happy about at all.

I am interested in this, as I love taking pictures of my child but you cant even take pictures of them on the beach, I have been asked to put my camera away and there was no one else there except me and her:eek:

the kids did a dancing performance at school and they performed at a theatre near to the school and the teachers were not allowed to take a picture of their pupils in their costumes on the stage  so for me a stranger (thats your pwc bdt) taking pictures of a child she has no relation to and absolutely no involvement with is a police offence and I should think it does not matter why she wants the picture that she cannot take one without permission. we need a solicitor really.
