How long does CCA Section 75 cover your goods for?

Hi,

I purchased a Dyson cleaner back in 2007 from woolworths. Sad to say the machine has now died (It wont start).

I phoned Dyson and they said its covered by a 5 year guarantee, however I have no receipt. She typed in the serial number which comes up as August 2005 when the machine was produced. She said if I can get a copy of my credit card statement then there wont be a problem with them repairing it.

I checked my Barclaycard account, however it only shows the last 6 months statements.

I phoned them up and was quoted £3 per statement - however I dont know the exact month when I purchased the Dyson.

As I paid for the Dyson on my credit card, how long does the S75 CCA apply for?

    What are you hoping that the CCA will achieve? I don't see that it will be able to help you if you don't know when the transaction took place.
  • It took place in 2007. I know I used my Barclaycard and I know the store was woolworths and which town I purchased it in.

    That isn't going to help is it? Unless you want to stump up £36 for a set of 2007 statements I don't think there's a lot else you can do.

    No. For once I am not being sarcastic. Let me rephrase my original question: why is the CCA relevant here and what do you want to achieve by using it?

    I will only know if its relevant if I can find out whether there is a time limit applied to items purchased on the credit card.

    I purchased the Dyson in 2007 on the credit card. The machine is now faulty and the shop I purchased it from no longer exists. I would expect a machine purchased for £299 to last longer then 2 years.

    You'd still have to prove to the card provider you bought in 2007 by getting a statement, surely?

    Quite. And I ask again: what do you hope to achieve with Section 75 of the Consumer Credit Act? You aren't hoping for a full refund are you?

    The short answer for the OP is 6 years from the date of the contract being concluded.

    As specified by The Limitations Act 1980.

    1. Sect 75 is totally irrelevant: "Section 75 does not, in itself, provide grounds for a claim against a supplier. Customers must have a valid claim of breach of contract or misrepresentation under other law, such as the Sale of Goods Act or the Misrepresentation Act" (Financial Ombudsman)
    It almost certainly doesn't apply on a second point of Law - it wasn't purchased from Dysons anyway !
    2. Dyson are acting quite Lawfully, they haven't said they won't honour their 5 year warranty - they just want to know that it is less than 5 years old. What is wrong with that ?
    3.You are entitled to get 6 years back info on your card under the Data Protection Act for £10. It won't be in statement form but the info will be there. You will find the info you need to do this on the bank charges thread.
