Sold the wrong laptop...what are my rights?

Hi

I purchased a Laptop from Comet and the sales person told me it has a blue ray player. The sticker on the laptop which gives bullet points of key features also shows Blu-Ray disc logo, which suggests it supports this format. However, it does NOT recognise this format. The laptop is only 2 weeks old and I got the 3 year cover with it too.

Can someone please advice me on what my rights are and what I can do.

    if it has been mis-sold then you have the right to return the product but relies on that little sticker and being able to prove what the sales person said any witnesses? any POS supporting the claim?

  • Well I hav'nt yet been able to get to them. I only just found out the problem now. I spoke to the call centre and they said that if the sticker is on the laptop then it suggests it SHOULD have blu-ray. I have been told to take it back to the store and speak to the management.

    As far as proof goes then its just my word against his, but there were two of them who told me it plays blu-ray. I didnt question them any further as they showed me the sticker...which was proof enough for me.

    What can I expect from them?

    A refund. And they might show you which one does have Blu-ray.

    Oh, and have you checked it's not just that it needs a driver or compatible software/disc? What does the drive show as in Device Manager?

  • Is that all? I thought they would be obliged to rectify their mistake by offering more things.

    How can I check this? Under device manager it says I have a "SlimType DVD A DS8A3S"

    Which laptop do you have, out of interest?

    And rectifying their mistake would be to put you both back in the position you started with - you have no laptop, they have no £x-hundred

  • My laptop is Acer Aspire 5738Z.

    The sticker on the laptop is false advertising, isn't it?

    Could be a mistake.

    There are several laptops with the model Acer 5738z, some would have Blu-rays, some not. If, by error, a batch have been labelled up with the wrong stickers, then of course, you should return it and get your money back. But it's not deliberate.

    It may just say Blu Ray compatible or Blu Ray Option.

    Have you actually checked it did state it had bluray and you didnt misunderstand. For example my laptop often has Bluetooth mentioned in the PR stuff and has a Bluetooth button. However its an optional item not in them all.

    These links suggeest to me it isnt Blu Ray and that you were told wrong. Problem is you cant prove what you were told.

    The sticker is probably irrelevent unless it states this laptop has blu ray. Stickers often mean "compatible". A lot of people got caught out by "HD Ready TV" when they first appeared.

    Go back in there with a tape recorder and ask the same bloke loads of different questions (doubt he'll remember you), mention model number on tape, then ask if it has blu-ray drive, when he says yes tell him Nooooo it doesn't you SOAB but that's what you told me last week, now gimme my money back! :) If he says no then burn the tape...

    First link Anihilator posted has "4X Blu-ray Disc™/DVD-Super Multi double-layer drive" listed in tech specs but second link has X by blu-ray, a bit contradictory, but if the stickers on there it should really have it, at the end of the day if you were missold it you need to go back there, let us know how you get on?
