can i end my 02 contract early? HELP!!!

I started my 18 month 02 contract with The Car Phone Warehouse, in late January 2009. Soon after I had a welcome call off 02, asking me if I would like to take up there insurance, I declined! But since february 2009 until late august 2009, 02 have been taking a monthly extras cost out of my account without permission. After realising this i phoned 02, who then later admitted to me over the phone that they should not of taken out the insurance and that the extra monthly costs would be credited to my account, but they still haven't done so! Can anyone tell me if i can end my contract early? Cheers Daz!

Doubt it the insurance would not be part of the contract but is a seperate contract in its own right. They have made a mistake but not in respect of your mobile phone contract.

You can buy out your contract but it will be your monthly basic cost multiplied by how many months you have left which I don't think you should do. Just make sure you get a refund for the extras you didn't want and stick with the contract.

If you are wanting to switch from O2 at the end, make sure you give them at least 30 days notice both over the phone and written (recorded delivery) as stopping phone contracts seems to be annoyingly difficult.
  • I this on your bill or an additional direct debit? O2 wont insure a third party phone so wouldn't have phoned you unless there has been a mix up.

  • As above, the insurance is not part of the contract.
So does not give you grounds to cancel. The best you will get is a refund, with potential compensation of loss of interest on the money taken.
