The Judge MUST comply with current legislation, the difficult is some District Judges are not fully aware of consumer legislation, don't take it for granted because it's a Judge they'll be upto date on Consumer legislation, the onus is on YOU (the defendant) to show highlight any parts of legislation the claimant has breachedClick here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -

Hello.
You are really worried... I have just joined the CCCS - DMP and it does say that any court issued or orders you do remain responsible for.....
Me personally, I would call CCCS as you did, but also call the creditor ref to your payments and make sure that have spoken to CCCS.
Tell them yourself that you are on a DMP, struggling to pay anymore and going to court is not going to change anything.
Be really nice to them.. be horrid they wont want to know !.. be calm.... and also follow up your call to the creditor with a letter: telling them your situation, give the CCCS act no and tele no,, ask them to call them direct.
You could also call CCCS and see if there is any creditor/s that payments could be reduced OR even reduce each one by £1.00 = 10 creditors = £10.00 so you can pay £36 per month... TRY THAT......
Just cover your back and chase up all options, but try the deduction first or just off one that has nearly finished ......
Good luck0 -
Good Luck debtman - I think you have made a good decision. Why let them trample all over you. You can do it.
I have a feeling that you have in your mind a court room from a tv series or something - the crown court where they have massive benches, and judges with wigs and jurors and legal teams etc.
Where you will be going is to the COunty Court and you will get a smallish room , a judge, a table and possibly if they be bothered to turn up , someone from the other side and possibly someone taking notes. The court system is for everybody - it is for people who have problems with their neighbours over the heights of their hedges, people getting divorced, people who run small business where people haven't paid etc. My point is it's for normal people and they won't expect you to be a qualified legal professional. All you need is to be you - yes you need to say what 10past6 has told you but that's about it. As long as you don't turn up in an ill fitting string vest, a beer belly hanging over some really dreadful holey jeans smelling like a sewer, swearing at the judge you will be fine. You haven't committed some dreadul crime - you're not a murderer or anything like that. The judges are normal people and are there to make sure people get treated fairly. In fact you will probably find the room etc pretty boring and not like you expected at all!
You can do this.
