how far back can we claim with credit card charges?

The reason I ask is I read somewhere (not sure where) that claims can go back 10 years, but that credit card companies only supply statements going back 6 years thereby limiting customers claims to 6 years.

I have successfully reclaimed from Capital One back to 2001 (kind of by accident as I have statements going back to then and just listed ALL charges ever added and they agreed after MCOL to refund the whole lot).

Now I have another claim going with MBNA, and their first offer (with cheque enclosed) was a small percentage of my claim, I wrote back saying thanks for the part-payment, but I would be pursuing the rest, then received a letter offering the rest of the charges but only going back 6 years. Can I continue pressing for the remainder even though they go back to 2002 (I have all my statements and it's about £200 more in charges).

So I don't know whether I was just lucky with Cap One that they refunded 8 years of charges, or whether it was because I have the statements to prove the charges??? Would like to pursue MBNA for the rest, but don't know if I would be wasting my time?

Anyone else claimed back further than 6 years??

    If you read the above post(BigBudgie on MSE) you will see that you can look at going back further than 6 years,

  • Thanks for that! I am penning a letter stating I will still pursue the remainder of the charges and have also included how the Limitations Act limitation period would only have been from the OFT statement in 2006, therefore, all charges back to 2000 would be refundable (if there were any, mine only go back to 2002)....just incase they were thinking of quoting the limitation act in their response!

    Ah well its' only the price of a stamp eh? I am now waiting on 7 claims that are with FOS (3 PPI and 4 credit card/store card charges), one PPI with barclaycard, one PPI with Morgan Stanley/Barclaycard, and Capital One who say they have settled after I MCOL'd them, but I have written to them stating that as I have no rpoof that it is settled I am not discontinuing my claim.....just a big waiting game now.....

  • Keep us updated, I'd like to know how you get on. I have statements going back to 2001, I just need to sit down and actually tot up the charges!

    Hi, I will do, is yours with MBNA or another provider? Capital One refunded my charges back to 2001, however, I had to file via MCOL as they only offered a small goodwill payment before.

    p.s. it's definately worth sitting down and totting up the charges, I have reclaimed almost £3500 so far, with a few I am still waiting on.....okay very little of that amount has physically come to me, but by having a huge chunk refunded to my accounts I have wiped years off my DMP......go for it!!!

  • Funnily enough mine is for Capital One as well lol. I've also got Barclaycard and Citi Card to claim for as well, I had a bad patch back in 2001 and that was back when their charges used to be £30 a pop for paying late/over limit so it will be interesting to see exactly how much I can claim back plus the interest. I'm going to try and do it this weekend, I am overun with paperwork! :rotfl:

    I was also overrun with paperwork, but got hold of some box files and filed everything...i.e. statements, copies of all my letters sent with the recorded delivery receipt stapled and all replies from the companies....plus a spreadsheet of where each claim is up to.......it has almost been a full-time job for me (but a good distraction as I lost my dad in August.....gave me something to focus my anger on!!).
    Put it this way...without my filing system I would have been overwhelmed with stuff......I have (had) 20 claims on the go........so far 9 settled in full, 8 with FOS and the remainder I am still waiting on.
    It's definately worth taking the time to do!!

    I'm just worried about reclaiming credit card charges whilst on a dmp.If the creditor has suspended interest and late fees etc do they ever reinstate them again once you put a claim in.Probably wouldn't be able to if debt has been passed to a dca but what if it hasn't.
    I dont want to rock the boat. I have only just started looking into this but have been encouraged by mojo jojo's fantastic results and being able to knock a few months off my dmp

    Same way you got the statements ie SAR for the lot. If they say that they do not go further back then ask them to provide a certificate of destruction for that data.

    I would ask for all the statements for the cost of £10.00. Add the charges up and see how much it comes to and then work out if it would clear your DMP if you reclaimed.
