What should i do?

I lost my phone two weeks ago and have got my replacement sim from 3. My contract ends in February 2010, but they have said they can supply me with a handset but it means i have to pay £39.15 for a samsung S7330 or £39.58 for a KU990 Viewty and my contract would be extended by another 6 months. I decided to go for the Samsung, it looked nice but i was unimpressed at the hatch door where you charge it up, looked like it would snap off.
They told me i was eligible for a free upgrade in November more than likely the phone i have my eye on, the N73. What should i do, should i go for the Viewty or wait to see what i get as an upgrade? I have a standby unlocked phone i am using my sim in at the moment.

    Just live with the standby phone you have - if you dont like that, get something cheap and chirpy from ebay. No point tying yourself into another 6 months without a decent phone or a phone you do not like. Its only a few months to wait...chill.
  • Have been on the phone to 3 they will not take it back as i have " personalised it" by setting date and time, i havent used the radio, camera, video, i havent made calls on it or received any neither have i put my sim in and the master reset doesnt change the time and date setting back to how it was when i got it. I argued that it wasnt personalising it as a person in the Uk who buys it next will put the date and time on, its not like i downloaded my own wallpaper or application, i'm really mad with them been a customer with them for 4 years and have 3 accounts with them. Are they right in saying they cannot take the phone back?

  • See if there is a 'hard' factory reset, i know on a Nokia if when turning it on and holding 4 really hard to press buttons at once, it will reset to the point of picking the language, date/time etc.

    Im a little confused thou, on your first post, you state you have 2 phones to pick from, and now you already have one?

  • Hi, i have the samsung one but i dont like the look of it, i'd have preferred the viewty one, now i cannot send it back as i have "personalised it" by putting in date and time and have an extra 6 months added to my contract to boot taking it to august 2010!! i am not a happy bunny:mad:

    As soon as you use it - it becomes personalized.
    You would have had a chance to return within first 7 days of having it - after that no.

    So have you already signed up to the extra 6 months?

    The hatch doors are pretty naff, the LG and Samsung seem to have those for the charge slot - they do last with care.

    In your situation and if I hated the phone and had no way to send it back, probably best course of action would be to flog it and get some dosh back (and get something else).

    you must also provide this information in writing
    the consumer has a cooling-off period of seven working days.

    They didnt supply any written information to the effect saying i shouldnt change the time and date settings and what they consider as "PERSONALISING THE PHONE", they pointed me to their website and said i was put through to the team dealing with terms and conditions, well she sure as hell didnt say not to turn the phone on which is what the other customer service rep said, then he said i should have received the terms and conditions with the handset, all i have is the delivery note, im not stupid, if i had a copy of rthe terms and conditions i'd have read it and not even attempted to turn the phone on at all!

  • You should have been informed on a leaflet in every 3 phone saying what you can and cant do if you want to return the handset.
    why should the network have to make a loss on a returned used phone.

    I never received any leaflet or terms and conditions with the handset, the phone isnt used, its just got the date and time put in, its what 99.99% of people would do when they get a new phone, ive just saved someone the trouble of doing it, theres nothing else personalised, how can date and time be personalised when everyone uses date and time??
