If you began checking every parcel before you signed for it, your postman will soon begin leaving those cards for you to go collect the parcel yourself.0

Postmen are not supposed to hand over Recorded or Special Delivery Items until they are actually signed for. So unless you have a very kind postie you should not be able to open a parcel before signing for it.
Also they have to keep their part of the contract to the sender by delivering the item to the addressee and having a parcel opened before it is stictly delivered (signed for) would be tampering with the post!AMAZON SELLERS CLUB member 0033 come and join us :j make some space and get hold of some cash, we're on the ebay and other auctions, car boot and jumble sales board0 -
Has any one had experience claiming through the small cliams court?
Is it worth the agro over a £55 item?? I've spent loads of time on this and now wondering if it's worth spending more time on the issue.0 -

i've had experience, it's crap

you pay £30....................they get a letter asking to pay + your costs, so that would be £85
they don't pay
you have to pay another £30 to call out baliffs
someone at the door then says 'they are not at this address any more'
you then have to find another address and pay another £30
etc, etc
they do get a CCJ against their name thomoney saving my @rse.
I've spent 10x as much as I would if I had never discovered this website :-)

I was at the other end of this sort of claim once. I sent an item, and a buyer claimed it was a slimmed down version of what I sent.
There was nothing I could do, the buyer fleeced me, took his money back (without any police report) and sent me back a slimmed down item instead of the full item I sent.
Basically the buyer committed FRAUD. It ruined my Christmas that year. I told them at paypal that if I had sent the slimmed down version the postage would be less (and I had all the proof of posting etc), and they said "we wouldn't normally take that sort of thing into account.
So basically they didn't care about the seller, just keeping the buyer's credit card company happy. If the police had become involved I would have won because they could have done checks on me to see what I'd bought and what I'd paid and I could have proved it all
It's good to hear that paypal appear to be protecting sellers a little by asking for police reports etc, but I'm sorry to hear of your poor experience with this seller

If the item was sent Recorded you should be able to claim for up to £32 from Royal Mail which is more than you paid for the item.
You just need to say that the item was stolen in transit. They may in general try and get out of paying claims and certainly try and pay you as little as possible, but I doubt that they will turn around and say that either you or the seller are a liar and refuse the claim.0 -
I think you misread the OP. The item cost £50 or more, it was the mailing cost that was £16. Apart from that, what you propose is dishonest.0
