Ford make me wait 4 months for new car (on scrappage) then say can't supply ???
Hi I orderd a Ford KA in June just before the Ford price increase. Managed to get 2k scrappage (miss the £600 increase) and £400 of extras included in the price.
Get a call in july saying won't be Sept 1st will be mid oct, then I call in today and they say it won't be then. They then tell me that it will may be next year and if the scrappage money runs out I will loose that too.
I believe as I have left a deposit a contract has been made. They did offer me the next model up in a colour i did not really want and wanted to charge £1150 more for that. The next model up is £600 and metalic paint is a £400 option so not what I want. I dont see why I should pay all that extra for what I dont want.
They have offered a refund but if I believe they should do more than that as a contract has been made as soon as they took my deposit.
Do I have any rights ?

I dont know what supply on KA's is like, but I would be surprised if it was that limited.
Have you tried calling Ford customer services to see what they say regarding supply, as it sounds to me as though they may be pulling a fast one to try and get you into a more expensive model from stock.
My local dealer is advertising Ka Zetecs for 7795 on scrappage, now I guess they wouldnt be offering that if they didnt have them0 -

Can you PM the OP with the details of your Ford dealer and give links to any adverts showing this deal.
It's actually helpful when people have disputes like this to be able to get information like this.I'm not cynical I'm realistic

best bet would be a letter to ford head office threatening legal action.
The cars are available but your retailer will only have been allocated limited stock which they have sold.
Other dealers will have been faster with their fingers when the stock was released and snaffled the majority into their stock and ring fenced them by tagging them as customer orders.
They will never release that car to your dealer but will sell it to you.
However the only person who can tell you where that stock is AND authorise the pre price rise price to be implemented will be uk sales director or above.
Hence my first line. A well worded letter will get you your car at the agreed price. Let them do the work for you. They are the ones who let the dealer down by being unable to supply.0 -

Unfortunately legally there probably isn't much recourse i'd suggest reading the t+c's on the order form you signed for starters. (does anyone ever read these...as unsurprisingly the reason its in small print and there are lots of them is cos they cover most eventualities)
If the head office route doesn't work then i'd try the following:
See if you find another dealer somewhere that can supply immediately and then ask the original dealer for your deposit back as they have failed to meet the terms of the contract (or they will fail). If they are been funny about it you might have to request the delivery in writing giving seven days notice and wait for this time to elapse (again this will be in the terms and conditions).0 -
The likely stumbling block might well be the "extras".
I am sure there is ample suppy of basic Ka's and this wont change but if you start requesting options etc then you will have to wait.
Unfortunately for the OP the terms will allow for delay so they either hold out and hope or just ask to cancel and look elsewhere.0 -

I stand by that statement. None of the dealers will know what stock is in the country unless its in their own group stock. That means that only somone at Ford HQ will be able to tell you what stock is physically available (and more important SCHEDULED for build or transport in the next couple of weeks)
In terms of authorising the PRE price rise price that will need to be signed off by UK sales director (although could be agreed by one of the Regional Directors or Senior Managers if its less than a grand.)
Your comments about finding another dealer that can find a car like that are way off the mark. Firstly its a non metallic and when dealers dress their stock they tend not to dress the new ka that way.
Old one yes and knock em out at 4995 in blue or red all day long but not the new one. With the options as well your chance of phoning any of the big groups and finding one are slim to say the least.
HQ will be able to tell you nearest matches and possibly sign off the price difference you would be hit with to go metallic which I think you will need to do to find the car your looking for.
Bearing in mind all this will hit Ford for at least 1k it wont be signed off by just anyone.0 -

Cant really answer that one without getting into trouble. These boards are monitored/ read by teams from most of the major manufacturers along with most of the serious owners forums.
Ka and Fiesta have been pushed back into really long lead times due to the scrappage deals not just here but abroad as well.
Scheduling for production is 6-9 months ahead so although colours and options can be changed easily enough we cant shift euro spec cars into uk spec cars.
Dealers fight it out for what production is out there and once they have it they will not let it go if its hot stock which is what Ka and anything else small is at the moment.
There are cars out there but the OP needs to remember that his dealer sees there biggest competitor as the Ford dealer 10 miles down the road. They wont be helping each other out. It just doesnt happen. (well very very rarely)0 -

Perhaps you would like to explain why Ford would get involved and "shell" out thousands of pounds when the dealer (who is the other party in the contract not Ford) hasn't even breached their contract. I look forward to the day when the uk sales director is signing of "minor" (sorry OP obviously not from your point of view but in the grand scheme of things) disputes between dealers and their customers. As it will probably mean he hasn't got anything else to worry about which would mean the economy and the Motor industry are back on the straight and narrow.
Anyway this is probably academic as the scrappage scheme has been extended.0
