A mess created for me by my bank

When I made the complaint via e mail (to the Director) I recieved a telephone call from him. He basically said that unfortunately for me I had been mistreated by the bank/business manager and that however unfortunate it was that I would be still responsible for the account. Which I can definately see from the banks point of view. They wouldn't need a guarantee if it's a sole trader account!
My argument was however, the bank had obtained the paper work from me twice, had recieved all documents asked for and failed to open the account over the ridiculous period of time and lead me to believe it was sorted (through various things mentioned in lunatic thread earlier).
Naive! Yes I am as I placed trust and faith in the system never doubting errors of this nature would happen, assuming the truth was told at all times and didn't consider human error.
I could kick myself for this alone! So back on track.......
Paperwork exists. So account should of. But....guarantor paper work does not exist. So is this a grey area? What if the bank had done its job? What if the manager had opened the account as arranged but without a guarantee!
Am I being dumb here? Am I being coherent? Its clear in my head but I don't know if I'm projecting this correctly.
Now all of that is whats on the tape. The Manager saying he has the papers somewhere and that he had lost them temporarily and that the account should of been opened and finally that he did not get a guarantee from me.
When I wrote to his Director via e mail (after Manager had not returned a dozen phone calls) I complained about the manager. He then got the manager to contact me via e mail to let me know what was going on about the account. In this e mail he changed the story which was taped. He said the account was not opened due to the id being incorrect and that he had informed me of this. This was all lies.
Infuriated I wrote to the Director again and said I could no longer deal with this man as his e mail had been self protectionist and deceitful. I then told him about the tape and what was on it. He has since told me at a meeting that he had told the manager that he knew he was lying as he had been taped by me.
At no point has he actually listened to the tape. I asked him at the meeting if he would like to and he said there was no need.
I don't know! Obviously it would be nice not to have the debt. Which is a fairytale but is there a chance this could work in my favour? I know it goes against all of the normal regulations of Banks and guarantees by Directors of the Company for Ltd accounts for obvious reasons. But could this man's mistakes be my saving grace?
Thats the bottom line really. Could I be saved by this? I just need to know if this is a dead horse that I am flogging. If you all think it is then I will know I am being ridiculous.

As for the rest of your post. Well, first of, it does make sense and you certainly have a complaint. What form of goodwill/ compensation that should take, I'm not entirely sure.
Like I've said previous, I'm not a knowledge in business banking, so can't really quantify the gravity of this administrative error of the bank. You're going to have to wait until a knowledge in this area replies, as I don't want to give duff advice.Anything I post is my opinion, so from time to time I may be wrong. I try to provide answers based in fact, however I don't know everything, so (like all posters on MSE), take what I say with a pinch of salt.0 -

Gunter i sincerely hope you sort it out, have you tried talking to your local Councillor or better still your MP, or write to the money section at a reputable newspaper maybe even watchdog programme, if you dont get anywhere from the other places you have seek help from? particularly watchdog or a newspaper seeing as you taped the man.My Signature is MY OWN!!0 -
As I see it you owe the money to the bank in a personal capacity.
If they/you had opened the Ltd company they would have taken a guarantee from you to cover the Ltd company's debts backed up by security if they had any sense.
So either way you owe the money - do you have a plan to repay?0 -
Well I am at the max with outgoings monthly as I support my family as the bread winner so to speak. Children at the awkward age, 3 and 6. Bless them but this does hold you back with both parents earning! So husband stays at home as school run expert whilst I go off and earn.
Because this is not the only debt I am at my limit but twice a year I am able to earn a lot at a trade show. So was hoping the bank would accept large payments rather than a monthly commitment. I do not have an exact wage monthly. Sometimes its good sometimes we scrape through. So every pay day I am biting my nails. The loans are paid for in 2 years and 3 years time when we will then feel a bit more relaxed but until then its a bit hair raising and I feel a bit stressed being the sole earner, keeping our heads above water and paying debt.0 -

Thank you I was beginning to think that i was a freak who had lost the concept of communication. I think I will look at that suggestion as I have nothing to lose.
It does seem all very convenient for the bank to treat this solely in their favour and sorry comes cheap to them. It would be "nice" if I was offered some sort of a goodwill gesture, whatever that might be!
Above all, I don't want to chase my tail and get myself upset if I have no rights. What's the point of that?
And yes JonesMUFCforever I do owe in a personal capacity but do you get what I said to Jambosans in the thread above about the fact that the papers exist for the account but the guarantor papers don't.
My opinion is why do I have to accept that I am liable when if they had done what they should of done then maybe just maybe I wouldn't be. Is that silly to think? They did not process, not me, I did my job but they didn't. Or does that not wash?0
