A mess created for me by my bank

  • So I gather then that no Ltd company was ever set up and bank are now chasing the OP for whatever debt there is.
    I agree with other posters being a mum and fulltime sandwich poster is no excuse for letting things slide for 2 years!

    I fear another post where someone else is to blame for their business going belly up.

    Does / did the Limited company actually exist as a completely seperate enterprise from yourself or did you maintain any 'sole trader' element at all?

    I'm assuming when you said the online banking let you change the name of the account, this must be a nickname on the service and not the physical account name?

    You do NOT always get a change of account number if you change the legal entity of a business, but often you do as it is a limited / PLC / LLP are completely seperate enterprises from the sole trader types. However is it your problem / fault if the bank didn't do it's job? No it's not. However you might remain personally liable anyway for the money owing even if it's a limited company account.

    How much are you now owing to the bank EXCLUDING charges added?
    These are my thoughts and no one else's, so like any public forum advice - check it out before entering into contracts or spending your hard earned cash!

    I don't know everything, however I do try to point people in the right direction but at the end of the day you can only ever help yourself!
  • I thanked Noh genuinely! Goodness!! I meant what I said I do admire someone with time to be organised. Please don't interpret everything in the negative. Message to Noh: The thank you was genuine! Why would thank you be interpreted as rude. Noh is a wonder act and whats rude with saying that? There are two ways to interpret everything choosing the negative would raise questions about you! Noh did you find the thank you as insulting? It was meant in good humour and hope it was taken that way.

    I'm reckoning the account on line would of let me call it anything although the director of the business manager did actually say it was strange that it let me change the name at all!
    From the moment of incorporation the sole trader ceased to exist.
    And wait for it £23000!! Yipes! There is a loan of £6500 but that is not in question it was a business loan on my personal name.

    The mum is not an excuse for my failure as a business woman! A great excuse for my haste in writing the first thread. I got carried away. What was going to be a couple of sentences turned into an illegible epic. But Noh saved me.

    It was interoperated as rude because of the over zealous nature of the comment. To remark someone is "super human", and asking "How do you have time to do things like that?" is sarcastic. Why? Because noh merely paragraphed your post, which you know is not some great task that would take a long period of time - so both comments appear sarcastic.

    How ridiculous, that comment gave no indication that it was humorous. This is a forum, so if you are have a dry whit in real life, it does not translate well into words unless it is obvious. Being a new member, we have no indication of your sense of humour, so most comments will be taken on face value. Therefore that comment came across as sarcastically rude.

    So you were being sarcastic and rude? Perhaps you meant it as a joke but there was no indication of this, just a blunt cheeky sarcastic comment.

    Although it seems to the contrary, I'm not trying to have a go, just trying to explain how those types of comments read. If it was genuine (which I just don't believe, as you even said it was meant in good humour, which suggests the first comment was a sarcastic joke), then I apologise.

  • OK all taken on board! I understand how I can be misinterpreted but please please understand even the good humour comment didn't mean sense of humour. I can't think of a better word.....good intention. Yes I am over zealous but not a nasty character. I am light hearted about my ridiculous life/situation. I like to laugh at myself not others. I am black and white not grey and I don't expect inbetween the lines to be read as there isn't anything inbetween. Truly truly its all positive stuff. So please can we start again as I understand how you probably thought ooh she sound like a right cow! I'm not! Maybe a silly cow who's in a mess but not a nasty one!! Forgive me??? I want to be in the gang of helpers but feel I have had a rocky start and have been outed already!

    Make sure this is the official complaints procedure for your bank. It is always worth checking their website for the complaints process. I would also consider putting everything down on an official letter of complaint. Make sure you are noting down times, dates and a record of conversation during any communication with the bank (particularly conversations). This way you will have a clear and concise record of events which you can forward on to the Ombudsman if you are not happy with the bank's response.

    Also, normally speaking, the Ombudsman will not deal with a complaint until the complaint has reached "deadlock" with the bank. If the bank have issued a Final Response/ deadlock to the complaint, what was their resolve? Beyond the F.O.S. you would be looking at court proceedings.

    I'm afraid that's all the advice I can give, I do not know enough about business banking to give help in this area. Although I'm sure someone else will be along soon.
