Argos returns

Hi, I've just bought a Sat Nav from Argos. I then realised my wife had also bought one. I had opened it but not taken it out. When I took it back to Argos with my receipt they wouldn't give me my money back as the small print said that that it wasn't available for the 30 day return.
Can this be when I had the receipt? I'm left with a £90 Sat Nav that I don't need.
Is there anything I can do?

    I don't know that there is much you can do as, as far as I am aware, stores only have to give refunds / replacements for faulty goods. Not just if you change your mind.

    I know Argos have a few things that are excluded from the 30 day returns period and I think it is mostly electrical stuff - certainly when I bought a digital photo frame from them they told me about the exclusion from 30 day return period.

    You could perhaps go back and explain you didn't realise about this exclusion and try and sweet-talk them into refunding you but I don't think you have the right to require them to do this.

    Now I have to pay the bills :eek:

    And feed my interiors addiction ;)

    Maybe go to a different store than the one you bought it from, and just lie and say its faulty :p Its worth a try

    You have no legal rights to return any item, if you simply don't want it any more...

    To be honest you're given the information at least three times in the ordering process.

    (a) In the catalogue there is a little cross next to the item description that explains that it's excluded.

    (b) On the website (if you reserved it) it tells you there with the product description.

    (c) At the till point you should've been told that it's exempt, or if you bought it at the quickpay then it prints a message on screen.

    (d) On your till receipt in some shape or form it will say "EXEMPT FROM 30 DAY GUARANTEE".


    If it was still shrinkwrapped then it wouldn't have been a problem, but it's not resaleable without it.

    Argos do seem to be able to use discretion on applying the policy. they have for me in the past. But I think they would look at whether it's resalable. Just breaking the shrink wrap can mean it's can't be resold.

    Maybe someone you know would like it as a Christmas present?
  • breaking the shrinkwrap means they do not know whether or not the unit has been turned on, and once satnavs are turned on the firmware is activate or something so i was told by my work and this makes them illegal to resale as new no matter the condition.

    as mentioned, shrinkwrap changes all this, your stuck, maybe sell it on ebay, or to family or friends for a tenner less?.

    Return the other one if possible?

    you buy something.

    You change your mind and decide you no longer need or want it.

    SOGA - your loss. It's NOT faulty. It is (we assume) fit for the purpose it has been sold for therefore you have NO RIGHT to a refund.

    Because the Sale Of Goods Act only protects YOU if the goods are faulty/not fit for the purpose for which they are sold.

    This Satnav isn't faulty and it will navigate by satellite. I suggest you take the advice to flog it to a colleague/mate for a discounted price..
