Is this fraud

hi, we have recently applied for tax credits and have my G/Fs son living with us. G/F split with ex 4yrs ago and has son 1 day a week and we have child benefit paid to us.
just recieved a phonecall from tax credits to say G/Fs ex has been claiming child tax credits for the past 4 yrs so our claim is on hold until we sign a form to say son lives with us.
will he be required to pay all or any of the money he's claimed and is it classed as fraud.

    Unless her name was on the TC claim then she would not be expected to pay it back.

    i forgot to say that G/Fs ex has never had son live with him apart from one night a week and has never had the child benefit paid to him.

    Am I misreading this. It seems you're saying that your girlfriend used to have her son for one day a week but now her son is living with you. If the lad was living with the ex then why should the ex not have been claiming tax credits?

    When we applied we thought ahead and sent copies of court orders etc. because they said they would have to contact the ex for confirmation that she was no longer living there.

    sorry for the confusion. my g/fs son lives full-time with us and has done for the last four years and we decided to claim tax credits as g/f lost her job and have found out that g/fs ex has been claiming child tax credit for four years even though g/fs son has allways lived full-time with us.

    has your GF ever claimed tax credits for her son? were they ever together with a joint claim?

    I think you have misread the beginning of the post.

    The g/f ex has him one day a week, (but it is a bit ambiguous)

    there was a joint claim but when g/f and ex split g/f stopped claiming.

  • I find it hard to see how the ex could get tax credits for him as you have to be getting the child benefit for any child you claim for. So if your GF had child benefit he could'nt get tax credits.
    I am wondering too why you never claimed for the last 4 years unless your salaries were more than 18K.

    So the ex has been claiming tax credits for 4 years for a child who is not living with him, am i reading that right?

    we were wondering too how g/fs ex has managed to claim ctc even though we have child benefit paid to us?? my g/f only just recently lost her job so that is why we are claiming now as i olny work 26 hours a week and earn £ 14,000.
