Well, thats naughty for a start, and yes, i would have put it down as fraud and will have to be paid back, maybe a fine too.make the most of it, we are only here for the weekend.

When she separated from her ex, did she actually inform tax credits she was no longer there and wanted to end the claim?
And, did she receive any paperwork from them about ending the claim?
Did she give them her new address?
She should also have received a renewal pack at the end of the tax year in which they parted, to finalise it, even if the award had been stopped.
If he has started up a new single claim, without her knowledge, then that is his problem.
However, if it is still a joint claim and she did not takes steps to end it, she may be in a bit of bother.
Unless she earned around £45-50k then I can't see why you two have not claimed anyway??0 -

tax credits is open to being fiddled
there was a man on a benefit buster type programme that every 9-10 months he put a claim in to tax credits saying hes girlfriend had a baby but the baby lives with him full time as she didnt want it so he got the money, he also said he had hes sisters/cousins kids aswell as they was unable to look after them.
in total he was claiming for about 39 kids and lived in a bedsit, he only got found out by someone informing on him i think, and even they was so suprised how easy he could do it
you do not have to provide proof of the child.
before my daughter was born i rang tax credits to find out what proof i needed to provide when my daughter is born they said all they need is the name and date of birth. so when she was born i rang them said her full name and date of birth and the money was in my bank within days
i couldnt belive they didnt want proof of that i had even had a child, no doctors note, birth certificate nothing just a name and date of birth

You don't need to be the child benefit claimant to claim tax credits - this is a common misconception. Why did your ex not claim CTC 4 years ago?0

Well my knowledge is you have to prove you have the child benefit in order to get the CTC. It's all linked.0

TCO verify the identity of your child through child benefit.
To claim child benefit you need the birth certificate.
The identity of the G/F's child was likely verified when she was in a joint claim so when the child appeared in a new single claim they don't need to verify the identity, they only need to make sure the child doesn't appear in another award. The reason why it was so easy for the ex-partner to claim is because the GF didnt claim CTC. Also, the GF will only be able to claim 3 months backdating so don't expect 4 years worth of CTC.0 -

I work for TCO, it is possible for one parent to claim child benefit and the other claim CTC.
If both parents try to claim the same benefits for the same children there is a dispute. TCO & CBO will then make a decision, based on statements made by both claimants, of who should be declared the main carer. CTC & Child Benefit would both be awarded to the main carer.0 -

Did her ex contribute to the financial welfare of the child? If so I don't see a major problem with him having claimed as he was a carer of the child even if not the main carer. At least the child, if he was helping financially, was provided for using money that the GF should probably have claimed in the first place. If he was not providing for the child then he is an [expletive]!
