Mbna loan ppi claims

Hi All,
Im new to this and after a bit of advice, please.
I had loan with ppi with mbna loans for £5000 for 2 years and then increased the loan 3 years ago to £26,000 with a total payable back of approx £32,000 I think over 4 years (I carn't find any of my details for the loan or the 1st loan) all I have is the bank statements with my monthly repayments of £680.00 per month going out of the bank and i think i have 11 months remaining. The payments are killing me.
I was advised when taking both loans that I would be refused credit if I didn't take out the protection due to the large amounts and not having anything to secure it against. I don't have my old details from the 1st loan before the increase.
a.) Has anybody had any successful claims for ppi with MBNA Loans?
b.) How can I find out my old details for the 1st loan with MBNA?
c.) Is this all really true and can it actually work, it all seems to good to be true.
Any advise would be greatly taken.
Thanks hopefully.
Kind Regards

Hello and welcome.;)

I assume you should have 2 separate agreements for these loans then, how long ago did you take out the first loan?
If you no paperwork I will post some details below on this matter.
I was advised when taking both loans that I would be refused credit if I didn't take out the protection due to the large amounts and not having anything to secure it against. I don't have my old details from the 1st loan before the increase.
In my opinion this was mis sold to you, with the reasons you have given here.
a.) Has anybody had any successful claims for ppi with MBNA Loans?
Yes many have had success with these, and when you get the chance, check this out on the above success thread.
b.) How can I find out my old details for the 1st loan with MBNA?
A subject access request (SAR) would be useful, (details below).
c.) Is this all really true and can it actually work, it all seems to good to be true.
You can reclaim on the PPI, if mis sold.;)
Any advise would be greatly taken.
Thanks hopefully.
Kind Regards

Many thanks for your speedy response and your advise. Do you think I have a case?
Sorry to be a pain, who should I make the cheque payable to?

You could continue to reclaim on that one where you already have the details for this one then if you want to, or wait to do this together with the other, if you were mis sold for the same reasons etc.;)
You could though try requesting for just the Agreement on the first loan if you want to, by just enclosing a £1 postal order or cheque payment, they have 12 days to supply this one.The one and only "Dizzy Di"0 -
Many Thanks, I think i'll send them seperate and start the ball rolling as soon as poss and send the current loan tomorrow and then request the info on the second one as well tomorrow.
I'll keep you informed.
Many thanks again for this help0 -
There are many templates for requesting for agreements, I have used this one before below which is from yet another site.
Dear Sir/Madam
Re:− Account/Reference Number
This letter is a formal request pursuant to s.77/78 of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide.
I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77 will apply.
If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties.
Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR).
I enclose a postal order in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose.
If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee.
We look forward to hearing from you.
Yours faithfullyThe one and only "Dizzy Di"0 -
