How to find someone?

Ok long story short, courts issued an emergency injunction on my violent ex a few weeks ago, a new court date was set to go back and review the injunction as nobody knew of his whereabouts for the injunction to be served.

The next court date is for tomorrow morning and the solicitors phoned me late this evening to say they hadnt been able to trace him so it was likely the judge was going to throw it out of court tomorrow.

However in my mind the solicitors havent done a great deal to try and find him aside from asking me twice if i knew of any addresses for him or any of his family or friends which i dont. I feel the solicitors should have been able to do a lot more even if it was asking me for names of family members so that they could try and trace their address  but they havent done so.

I have spent money using online sites such as 192.com and others trying to trace an address for him or his family members and have had no luck, either they are not registered or they are not appearing on the public register. The only details i have been able to obtain are addresses from pre 2007 whilst we were still together, the address we lived at together, his fathers address that im aware he has moved out of.

Is there anyway of finding out where he is other than the routes i have already tried? The CSA have only just been able to find an address for him after he started to claim JSA, but obviously due to the DPA they cant release this information to me.

I have decided against attending the court hearing tomorrow, both myself and my children are unwell and it also means me going into the area in which he lives in putting myself at risk while i am there (the last known place i knew he was living is the road backing the court itself  ) I really cant deal with the stress of having to go back there tomorrow for it to be thrown out of court.

Has anyone any other suggestions as to how i may be able to trace him as the solicitors dont seem to be doing anything.

Surely the court bailiffs will be able to access this information to serve papers on him - if they are made aware that the DWP have that address?

Well this is what i thought

Originally the solicitors told me that they had a tracing service that they use which they would use to try and find him however this doesnt appear to have been done

I just feel like it has all been left down to me to sort out which surely is the job of the solicitors and the courts :o

He is on facebook however he found me rather than the other way round and he started threatening me which is what brought all this about again i have asked a fair few people but nobody is willing to give me his address.

For some reason he seems to have some sort of hold of over everyone

AND the CSA can disclose this information to the court

Has he tried to contact you at all in the time that the injunction has been in place or is there any chance he has moved out of the area

No one at acourt would look at a social networking site - they wouldn't even be able toaccess it due to HMCS control restrictions on the internet, you would need to get print outs and present them at court. If you do not attend court then I cannot see how the injunction will be renewed , particularly if your solicitor is as useless as you suggest

No not so far, but the order had only been in place for 2 weeks.
He definatly hasnt moved out of the area as he has been seen by friends of mine.

The last definate address that i had for him was in the road directly behind the courts which as far as im aware the new gf is still living at now, both of my children are ill and off school which is the main reason that i didnt attend and the solicitors were aware of this.

I dont actually know the outcome of what happened in court yesterday as i havent heard from the solicitors since, but im going to give them a call as soon as my house phone has recharged it got left off the hook and keeps dying on me  :rotfl:

Im most definatly going to be asking the solicitors what they actually did in an attempt to find him, to me they could have asked me for his parents names, gfs name etc so that they could have attempted to find the address themselves, they had informed me that it could be served to a family member or friends address so that he would still receive it but they dont seem to have done a great deal considering they havent even asked!!

I was mainly asking to see if there was anymore i could do other than what i have already done, seems there obviously isnt though :o

    Thanks for your help :)

  • The CSA can and indeed must give the address to the court if they ask for it but this will only happen if someone turns up at court and tells the judge this. Otherwise how will he know to ask them.

The solicitor did attend on my behalf, as i stated in the above post though i havent heard back from the solicitors as yet and am waiting for my house phone to charge so that i can ring them :)
