i recieved a letter today from debitas, only the 3rd one i have received, adv thatcourt proceedings will comence if i dont contact them. I called them as i did on the previous occasions, but found that they were still very rude and intimidating and would not listen to anything i said, and for some reason kept repeating themselves. I tried to tell them what i could realistically afford to pay each month, which they rejected and advised that i would have to pay at least twice what i offered, in the end i got soooo annoyed that i asked to speak to a supervisor, but was just given the same speech.
Has anyone any advice on how to deal with these people?
I used to work on a collections helpline to try and actually help people to arrange plan that they could afford, but these people are just plain idiots if they think that anyone is going to pay something which is way out of reach. :mad:

So far, if they do take this to court, you have no proof that you have been trying to agree payments. I suggest you stop talking to them over the phone - you have discovered that this is a waste of time.
Write to them making an offer of payment towards the debt and include a payment with the letter (sent recorded delivery). I doubt they will send back the payment. As long as you make the payments i think they may be more inclined to keep taking them - if nothing else this would demonstrate to the court a willingness to pay.
Have you verified that this debt is yours and that it is not statute barred?After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

Don't speak to these bullies on the phone, always communicate in writing, you will never get anything from them by phone.
Do you have a debt with debitas? Do you agree that you owe them money? What was the debt for originally? When did you last pay debitas or the original creditor?

(you will need to amend them to fit your circumstances but these should give you a starting point).

I am having similar problems with Debitas. Here is a copy of the letter I have just sent that explains what has happened over recent weeks.
Does anyone think I am being unreasonable? I am trying to negotiate a monthly payment yet they want one every time I call. Time to resort to letters:

Hi James - you are not being unreasonable, however I would definatley stop speaking to debitas on the phone, as you have found anything agreed means very little and they will always bully you for a little bit more. The only way to set up a payment plan which will have any effect is to do it in writing, send your letters registered and keep copies of all correspondance.
I think the problem you are having is that you are being too reasonable. Take control back of the situation. You will offer them one payment a month for whatever you can realistically afford. No matter what they say there is not actually that much they can do if you take this action.
Debitas like many DCAs are really difficult to deal with and will happily lie about their powers over the phone. They are much less likely to do this in a letter.

So I thought I would update you all. I finally got a reply to the letter I posted here that I sent to Debitas questioning their reluctance to set up a monthly payment until i paid a holding sum and then the first monthly instalment. I explained i could only afford £100 a month no matter what they called it.
The letter I received back just said please phone us!!!
So yesterday i thought I would. I basically told them I want to clear the debt as soon as possible and that £100 was all i had and even that was tight. I even told them I had found an extra £30 this month. I finally got someone who seemed to want to help rather than just read out the same lines I always hear.
He wanted me to set up the plan straight away but I explained I had no more money until the end of the month. He has put the account on hold until Nov 20th at which point I am told I can set up a payment plan to start at the end of November to coincide with my payday. I bet when I call back on the 20th I get someone else who will want more money first!!0
