Right To Claim Compensation From Tesco?

Hello All,

I am a new member here and would appreciate some opinions on whether people think I am entilted to claim compensation, as I have never done before.

I recently bought a 12 pack of the drinks J20 for my daughter (aged 13) on the monthly shopping trip. Now these in the 12 pack are well packed and nothing was noticed, put away in the cupboard.

I heard her mention 1 was broken, and she put it in the bin, however upon the packet being open when I looked in, I saw they were covered in what appears to be blood! this adds up with the broken bottle, and its alot! even round the rim of the bottles.

To say I was upset was a understatement, my daughter had already drunk from 3 of them, and I really do not know what to do now. I was of course upset with her for not noticing, bit with fairness to her the bottles she drunk from had 1 or 2 specs on, and she was not sure, although she should have asked!

Any comments, views or suggestions welcome.

    They logged a report on the till, and said they will contact me within 8 weeks, I felt very fobbed off though to be honest
  • Accidents happen. Why do you feel you are entitled to compensation from this? Has actual harm been sustained to you or your immediate family?

    The best you can realistically hope for is a replacement, your money back, and if you kick up enough stink at customer services, maybe a £50 gift card.

    Im sorry but if this happened it shopuld have been reported, obviously it was a substantial bleed, and they must have known it happened. Hence not got to shelf, when my kids drink from bottles that have been contaiminated round blood, I feel like something shold be done about it!

    Erm, because it is a serious health issue, not in a saleable condition and totally discusting!

    You obviously wouldn't mind drinking from bottles covered in blood?

    not to sound at all rude, but you need to be responsible for it.why should tesco be responsible for it now? if at all, they hardly meant to sell it to you if indeed it was damaged in the store, didnt you notice when you picked up the drink box that one might have been broken? wet packaging, broken bits etc? so your daughter had drunk 4 of them before you knew one was broken?
    ps off topic have you seen how much sugar is put into those drinks,they arent ideal drinks to give kids.
    plus in could have haapened anywhere from the manufactures, to transit, to the numerous warehouses,before its even seen by tesco

    My Daughter has 1 every couple of days, and no the packaging was not wet until the bottle got dislodged, thanks for the parenting advice though. Sorry I bothered to bring this up and enjoy yourselves, I actually feel like ive done something wrong here!

    Do you know what, you have been rude. It is none of your business what the OP gives his daughter to drink- high sugar content or not, who are you to judge?

    It is also irrelevent what happened to the drinks before being delivered to Tesco; they were sold by Tesco, who have a duty to sell goods which are safe and edible. IMO bottles splattered with dried blood are neither.

    To the OP: personally I would contact Trading Standards and possibly someone to do with consumer health (environmental health??). Good luck- I hope you get a satisfactory conclusion.

    Somewhere along the production process, something has gone wrong. This error was not noticed and unfortunately the goods made it to the shelf.

    As noted, Tesco will probably give you a gift card for your inconvenience.

    What would you like Tesco to do for you? How much money would you like out of them? :confused:

  • I think what people mean is what do you want?

    £10, £50, a bunch of flowers, trolley dash?

    On discovering your daughter had drank from contaminated bottles did you contact NHS direct or Tesco first?

    I would make as much fuss as you can be bothered to make and see what you get, thats what I would do. How for a few quid for nothing.

    Anyone about to tell me this drives up prices is kidding themselves. Tesco will charge as much as they can, whenever they can for as long as they can along with the rest regardless and the only thing affecting prices is our gullibility.

    Go for it, just don't try and kid us or yourself your doing it for the future of our children. ;)
