Council starting major works before consultation period finished?

i was in this position myself when buying a flat - it was discovered by my solicitor that the council had not followed the correct procedure and all i had to pay was £250 - but it was several legal letters to the council before they accepted they were in the wrong0 -

Sorry, I missed out the preamble in order to keep the OP brief. I had already posted a short while ago about the consultation and some helpful people on here pointed me at the complete section 20 wording on the LEASE site. The situation is, they only need to do a 1 stage consultation as it is part of a 'qualifying long-term agreement', i.e. the contractor is already in place. Council claim the counsultation for this was in 2004 but I do not recall being consulted on this and I have no paperwork on it (and I am meticulous about keeping my paperwork), but that is another issue and is probably too far in the past to drag up.
So their consultation on this work itself has been correct so far, but that does not change the fact that the consultation period IS NOT EVEN OVER YET.
I'm aware (as per my 2nd post on this thread) that they can go ahead regardless of our objections, but surely not DURING THE CONSULTATION PERIOD???
Anyway, will be onto LEASE on the phone in the morning.
