How would an Au-pair affect my Benefits?

    If you get DLA care middle rate or above then non dep deductions would not be taken from your HB/CTB because of the Au Pair.

    Do you get LHA or HB?

    There would not be any non dependant deductions if any rate of DLA care is paid.

    erm... I don't get anything since some joker at the DWP provided false information about my getting WTC to the council... but assuming that it gets reinstated at some point...

    I don't know? I thought HB was worked out using the LHA, or am I totally confused? The paperwork from the council only refers to 'Housing & Council Tax Benefit'.

    Did a little digging... here's what it says on the council website:

    "From 7th April 2008 Local Housing Allowance is being introduced for some private tenant Housing Benefit Claimants. Local Housing Allowance will be based on the Area in which they live, Size of the household, a rate based on the number of rooms required by the household composition.
    Any new claims received which are due to start on or after this date will be assessed under the new rules.
    As currently with Housing Benefit, entitlement to the LHA will be subject to a means test and proof of a valid tenancy. Payments will be made to the tenant rather than the Landlord."

    so I wasn't confused but I now understand the question :-)

    Why do the Council think you get WTC... Has there been a data match. The Council should have on line access to get confirmation as to what TC's you get and the amount. If i were you i'd be trying to find out today! If there is a problem with yur TC's you need to be getting it sorted out before it causes other benefits to be suspended.

    HMRC keep telling me when I ring that there's no problem and then sending me letters saying there is. There's a lovely lady coming to visit in about an hour's time specifically to try and sort this out so I can see a light, I just hope it's the one at the end of the tunnel LOL

    Thank heavens for Prozac, the sheer complexity of the mess was making me suicidal a couple of weeks ago, every time I got another envelope with green edges or with return address for ATOS I started shaking. Now I feel I can start working on one problem at a time.

    Just in case anyone else needs to know, apparently ESA shouldn't be affected by having a non-dependent living with you if you are employing that person because they wouldn't be expected to be paying for their board.

    There's a new claim in for ESA, I'll have to go back to the GP for a new sick cert to replace the one I sent them before but it's underway! I had to sleep for a couple of hours after making the phonecall but at least this time I know that there's a real person to help me who knows what they're doing.
    HB is in the process of being processed so that they can process it?!?!? But it looks like it's going to be another fight because they are currently counting my personal budget from social services as savings.
    CTC looks as if it's OK
    HealthyStart Vouchers - who knows, it's relatively minor in the grand scheme of things! But as I haven't heard from them I think it's going to have to be chased in writing.

    Thank you Zara, battling with all these agencies and forms and rules is so exhausting, it's so nice to get past the ignorant comments and get support from the helpful people on here.

    Deep Joy. My provisional assessment of HB was made taking into account the care budget that's sitting in one of my bank accounts waiting for an invoice from the agency...
