when people say 'is it your fence' they dont mean did you buy and install the panels. They mean is it legally yours to look after or your neighbours. In my street for instance the fence to the back and the right belong to the homeowner and the fence on the left is the neighbours (and if you put in new panels on the left its still the neighbours so dont do their work for them!)

  • I think I understand now - so instead of a fence out the side of your house you will have a brick wall right up where the fence was? If they removed a gate that was entirely on your property they should put it back where it was. I don't really know about the fence part, but I would think they should re-instate it next to new wall regardless, although there might be problems with your roof dumping water onto their roof or walls.

You've more or less got it right, the fence as you look at the front of our house is on the right hand side ( so can't confirm that its our fence though we put it up.) The builders have mentioned about the water problem but hopefully there may be a way round the problem

    I'm trying to visualise this.

So this storage space with fence and roof is down the side of your house, between your house and next door? This is where you kept the dog sometimes too so needed a gate to close that little section off?

The builders removed some of the fence and so now you've just got a much smaller bit left right at the back between the two houses?

Sorry, we dont keep the dog in this storage space!! We have 2 gates, one at the garden end of the house and the other at the front of the house ( this space goes along the right hand side of our house) and the gates are used for keeping the dog in the garden, other wise she'd be running up and the road!!!!

You looked into whether they got planning? Isn't that the sort of thing that sorts ways out round water problems?
  • So the gate now needs to be secured against the neighbours' extension wall rather than the fence which was there before. Is that it? I'm finding this really difficult to visualise as I can't see where the fence-panels come into the equation.

Have a look now on your council's website.
look for planning and see if you can browse online for the planning permission.
  • I suggest your parents invite them round for a nice cup of tea and sort everything out like civilised adults.

It will be cheaper in the long run.
    Been away for a while.
  • the fact they built right up to the boundary is an issue with the fact they removed YOUR fence and YOUR shed/storage area that cannot be reinstated properly. I might be wrong but I was under the impression that if it is to be built right up to the boundary correct me if wrong but is class as party wall agreement and needs full planning permission. time they had a chat with building control,
At the end of the day if the extension is not the issue but the loss of storage is then it is up the neighbous to correct this. Even if it costs them. the gate was an easy way out and selfishly does not help. There are ways for them to mount a cover but it will cost a few hundred pounds to do so as to not affect the brickwork either side with damp
  • thx everyone for advice
