Can I cancel a contract?

I upgraded my vodafone contract in a Phones4u store on Saturday. I'm not happy with the phone at all, and feel I got conned by the woman in the store in regard to insurance.
I have called my local store in Worcester who tell me I cannot return the phone and get a refund.
I've spoken with Ofcom and Consumer direct who advise me that any contract signed on the business premesis are not covered by any form of obligitory cooling off period.
Does anyone know if there is any way to get a contract cancelled with Phones4u?
I am so angry with their customer service, they have made absolutely no effort to help, they havent even offered to give me a different handset.

Can I ask what the insurance has to do with the contract - can't you just cancel the insurance after a month?0

Unlikely, Upgrades are not considered new contracts as such so you don't normally get a cooling off period you may with a new contract.
And as you know anything signed in store does not hav ea cooling off period (unlike online or phone upgrades that are covered by the distance selling rules).
It may be worth going to the store and seeing if they have any info on "7 day returns2 although it may exclude upgrades. You can also try calling their customer services and ask for a goodwill gesture but I'd say you are unlikely to get very far. Sorry.0 -
With insurance you generally have a right to cancel within 14/28 days.
With the phone you get 7 days if purchased on-line, due to distance selling regulations.
As you have purchased in the shop, you have no rights to return the phone as it is deemed you have a fair chance to examine the item. only if it is faulty can you return it. Shops may voluntarily offer to take returns/offer exchanges, but so long as the phone is not faulty they are not legally obliged to do so.
Can you expand on why you feel you were conned.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

As said above, they have absolutely no reason to change your phone, contract or anything. With most High Street stores allowing customers to return things they bought because they changed their minds, some people think it is their right so to do.
Not so and it is not a reflection on Phones4u's poor customer service as you stated, but more on your failure to check out your purchase's features in advance or even take time to think about the offer over a cup of coffee before signing.
You are entirely in their hands and will need to sweet talk them into making any changes.0 -

That does not apply to upgrades, which is what the OP took out. A common misconception.0 -

I guess that is because it is not something completely new. Feels like a bit of a loophole as the phone is at least new and is a physical item sent to you. i missed gjchester's post.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
