home buying - question on insurance/indeemnity/planning

Hi, a few questions for the guru's[FONT=&quot]

[/FONT]I am in the process of buying a house and a few minor (i think) things have come up. My solicitor seems to be well on top of things but I just want to double check a few things.

1. Only Possessory title on garage[FONT=&quot]
[/FONT]The garage is away from the plot that the house sits on and is in amongst a block of garages. It seems that there is only a possesory title in existence for this garage. My solicitor is asking for indemnity insurance from the sellers - what does this mean ? (I assume it simply means they pay for some form of insurance that will pay me if complications arise in the future)[FONT=&quot]

[/FONT]2. Building insurance[FONT=&quot]
[/FONT]I was under the impression that I can cover this myself through say Tesco or any other provider, rather than my mortgage lender. But How can I be sure that this would be satisfactory and would meet the strict criteria laid down by the council of mortgage lenders?[FONT=&quot]

[/FONT]3. Building work carried out[FONT=&quot]
[/FONT]A slightly interesting one this: Basically the place I am buying has had quite a bit of work done on it over the years including an integral garage being turned into a dining room and a bedroom put on top. The original conveyance says that no constructions in excess of 10 feet should be built. - this work is obviously contravenes this constraint, however planning permission was granted - so surely thats that done and dusted and all above board ? (My solicitor is asking for a consent document from the original developer or successor on this, or for an indemnity policy) - So should I be worried about this ?[FONT=&quot]

  • Your solicitor is on the case and, it seems, asking the right questions and giving you the right advice.

    Most buildings insurance policies are effectively the same and cover all the things that are needed. The excess for subsidence mustn't be more than £1,000 and lenders vary as to the excesses for other risks - if you know where to find the CML handbook on the web you can check your lender's requirements for that. The other thing is you must make sure that the interest of the lender is at least noted on the policy. In some cases lenders want to be joint insured with you.
