PLEASE HELP! I'm being THROWN OUT of my student accomodation...

    This is a very serious implication. I find it very hard to believe that Students would abuse themselves in this way...and I'm a man of the world!!!!

    Not quite as clear cut as it looks above. This is an unnumbered sub clause as part of 3.15, which has 4 numbered sub clauses, and covers Transfer of Tenancy. I think that this has no bearing on the question of guests

    The only mention of guests is in 3.17.4, which presumes the existence of guests, but does not otherwise delimit them. And I can't fully go along with the earlier contention that if the 'host' is not present, then 'guests' are no longer guests.

    There is a difference between guests who are there with the tenant, or at least when the tenant has moved in, and guests who take up occupancy before the tenant arrives.

    Imagine this out of a student situation. Landlord lets a flat and tenant allows friends to move in before taking residency. Landlord hears about it is when the neighbour complains of excessive noise. On investigation landlord finds no official tenant and two other people claiming to be friends of tenant who have clearly moved in, in tenants absence. Landlord is not going to be pleased.

    imagine how I felt when I entered the flat I had jus bought (completed on) and not only found it full of furniture but someone asleep on the sofa who when asked 'what are you doing here?' replied 'I live here!'

    There is indeed a difference, and I can imagine.

    But AFAICS, the difference is between guests and unauthorized guests, rather than between guests and sub tenants - possibly depending on what rights the guests seek to assert.

    I live in Sheffield and if you need a place to stay we can sort you out a place to rent ASAP, don't stress about that 'cos I've got a spare room if push comes to shove!

    - Get everything in writing from the manager (he's not the Landlord he's the manager and doesn't have that much control - no matter what the manager thinks)

    - Book an appointment and get yourself down to the Student Union - its pointless having the best Union in the country if you are not going to utilise their help.

    - You said you are a Law Student, have you approached your personal tutor for advice? They could pen a letter if you do need to stall for time to get a place.

    - Deposit - I presume that UNITE are not that stupid and have your deposit in a deposit scheme which you have a chance of getting back.

    - Renting in god awful student blocks. I hope you have now learned your lesson and will now move up the hill to the lovely area of Crookes or Walkley or Broomhill or Ekky Road where you can rent a house and have people stay over whilst your away!!! (I hate the ugly student blocks that have taken over the area by the University Roundabout)

    - ignore me.... rant over.

    - They have to give you two months written notice to kick you out... (section 21)

    Hope that helps, if you need any advice GO TO THE UNION because they are brilliant and have helped me out with housing issues previously.
