Get a solicitor to send a letter to the telephone company requesting the full records. The telephone company and the solicitor will charge for this. In court the police may claim that you were still using the device despite what the records show. "Using" is not a cast iron definition, its flexibility has cost people dear.

Agree about the solicitor. But there is no automatic guarantee that you will be awarded costs if you win.
I've always got costs awarded for cases I've won in the Magistrates' Court.

The best way to go about it is to ask, as soon as they say "case dismissed", for an award of costs from central funds and hand over your itemised costs schedule, because the Mags have the discretion to make an award there and then. If you submit it later by post, some back office clerk will whittle down the amount by what they refer to a "taxing".

Anyway a competent solicitor will know how to go about this.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Once again, excellent and cogent advice from bargepole.
    I concur fully.

My hubby went to the main office the afternoon it happened as he was quite annoyed and explained all about the carkit and the officer refusing to even look at it and was asked was it vindictive or could it have been a genuine mistake, the officer who spoke to my hubby said he was the first person to come in and querie the charge and believed/sympathised hubby but said it had to go to court, plus the carkit was fitted by the dealership when we bought the car so there is no doubt of it being fitted recently. The phone records have been requested but we dont know how long these take to come through or even how long before we hear anything from the police/court?

    Thanks for looking in.
If they won't take your complaint seriously or refuse to deal with it, ask to speak to a Senior Officer. If they still refuse then ask for the officers badge number and the number for the Chief Constable. I've found this method useful in getting some co-operation when the local cops didn't want to know.
