The officer will need to have some evidence, surely?

Yes. The verbal evidence of the officers. Which will always have more clout than the verbal evidence of the defendant.

What is privacy glass? genuine question as I cant think of any cars that would have blacked out (if that is the same) windows in the front doors or windscreen

the police can use their own judgement and at the roadside, the husband should of explained the situation clearly. also, far better to 'pay under protest' and appeal, than refuse and go to court...

You cannot pay a fixed penalty under protest and then appeal. By paying, you are accepting the fixed penalty. The way not to accept it is to request a court hearing.

I suspect you know what privacy glass is (and where it can be fitted) and are merely making a point by asking the question, but giving you the benefit of the doubt....

I suspect in this case that it is factory fitted tinted glass which is fitted to the rear and side rear windows of the car to reduce the amount of light that can pass through the glass. The term privacy glass indicates that it offers a certain degree of privacy for passengers in the rear of the car.

Its illegal to have anything but a very slight tint fitted on the front side windows, normally they are clear, so the driver would have been in full view of the Police Officers when he was / wasn't on the phone.

Of course they didn't. Policemen never tell lies. ;)

Privacy glass is tinted glass that came with the car when we bought it in the back passanger doors and in the boot, it is darker and harder to see through and doesnt let the sun rays in which stops the kids squinting if the sun is out. And at the time I was under the impression the police were behind hubby hence how could they see.
