Just Bought Yummy M&Ms... A Month Out Of Date

Hello everyone,

I did a quick search but couldn't find anything & was wondering if anyone could help?

I just bought some M&Ms from Tesco and although I tend to always check dates on packets these days, I picked these up from the till and popped them on the checkout without thinking. I just opened the packet, turned it over to check (just incase) and was glad I looked as these were out of date in August.

Does anyone know what customer rights are with regards to out of date products like this? Chocolate usually has a good couple of months, into next year for example, so being a month past the date is quite bad. Should I return to these to Tesco (who will just refund me a few pennies and say sorry if I'm lucky), call/email them or is there anyone else I should take this to? It's not the first time I've noticed it, but it's the first time I've been stupid enough to buy without checking the date.

    It's only a best before date, not a use by date. It is not an offence to sell food beyond it's best before date unless it's condition has deteriorated. As you were happily munching on your M&M's until you turned the bag over and saw the date I doubt this would be the case. So no, it's not bad at all really. And August was only 2 weeks ago.

    Go back to Tescos if you really want, I'm sure they'll happliy give you a refund for 40 odd p.

    Well its now nearly three hours since OP posted.

    Assuming she[1] is not dead already[2],
    do we need to do anything to ensure she survives this traumatic ordeal?



    [1] well OP cannot be a 'he' surely. :D

    [2] is it safe to assume she is not dead already?
