Thanks for all your replies - we'll see what happens. He IS actually usually a very safe driver - he's been driving for a year and a half after all - and as I said, this was all to do with newly acquired speed and being 17 - it was on an empty dual carriageway and he was stopped 10 yards before the speed limit changed to 70mph so not perhaps quite as deadly as it sounded. I drive down the same road every day and am ALWAYS overtaken by motorists accelerating towards the delimited sign! I honestly think that being stopped in itself was enough to knock some sense into him - he has kept well within speed limits ever since - but if he gets a ban he'll just have to live with it. he will get his license revoked meaning it test time again and may have to do a extended test ,if he is very unlucky ,
if he has held a license for less than 2 years,thats a full bike license less than 2 years
fine will be what they want at the time and with it been over 30mph of the speed limit, your at the mercy of the gods put it's under 100mph in a 50 so no prisonthere or their,one day i might us the right one ,until then tuff0 -
He will certainly receive a ban and have to retake his test.
As his parent, you should be hoping it is a very long ban and he doesn't get back behind the wheel for a very long time, if he does, that phonecall from the hospital is a very likely call.
If you get a ban- say 28 days he may not have to do a retest surely? Indeed it might be preferable to 6 points and revoked license.
Not clear cut how it will go- depends on factors but to speculate say £200 and 5 points might well be a good result for him in getting to drive home but insurance :eek:0 -

It's normaly suggested to the Magistrate that 30mph over the limit should result in a ban unless financial hardship will ensue. As he has held his license for less than 2 years he will also need to retake his tests from the begining if he is banned.
To mchale, as this offence was dealt with at the scene, by a real Police officer instead of a camera the NIP does not need to be recieved within 14 days as it would have been given at the time. The 6 month rule applies though as speeding is subject to the limitation of proceedings and must be dealt with within 6 months of the offence.0 -

Who would get jailed. A motorbiker speeding or a car driver who kills someone whilst texting?0 -
Did he get a NIP within 14 days of the offence? and/or did the summons arrive within 6 months of the offence?
Notices (NIPs) are sent in cases where you haven't been stopped by police (eg after being caught speeding/jumping red lights on camera)
In this case the OP says:The policeman who pulled him over did say he would have a summons
So no need for a NIP0 -
Thats bad news, we were all young once, it wasn't like he was driving car at 45 past a school, I think the police should be harder on speeders in built up areas rather than hiding behind hedges on open roads!
It might be worth going over the evidence as much as you can, check all the dates, times, everything. I got caught when they made the 1/2 mile stretch of straight road into a local, village a 30 from a national speed limit, there was just one small sign at the start when you come off a roundabout, which I missed. I went over the NIP and found they had the model of my car wrong, I informed them that I did not own the car mentioned in the ticket and heard no more
The road has now gone back to a national speed limit as well! 0 -

The new drivers act specifically relates to penalty points within 2 years of passing a driving test. Unless a ban is accompanied by points then a ban is all it is, the licence is withdrawn for the period of the ban... not revoked!!
After serving the ban there is no need to resit any driving test unless this is part of the ruling made by the magistrates.Always try to be at least half the person your dog thinks you are!0 -

I'll admit, the last time I was in Magistrates' court defending a young speeder was a few years ago but;
case law suggests that, any person proven exceeding the speed limit by more than 30mph will be liable to a ban, a fine not exceeding level 3 on the scale and 6 penalty points.
Under the new drivers act 1995 if he does get 6 points from the offence then his license will be revoked aswell.
